AjRESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIDNERS OF MONROE COUNTY, FLORIDA, DIRECTING
M~ ROBERT C. APGAR, ESQ., LEGAL COUNSEL TO
THE BOARD REGARDING THE MONROE COUNTY YEAR
2~lO COMPREHENSIVE PLAN, TO CEASE OPPOSITION
TIt THAT PORTION OF DCA RULE 28-20 AMENDING

TBiOUGH 101.4.24 UNDER OBJECTIVE 101.4 OF
THR COMPREHENSIVE PLAN.
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, adopted the Monroe County Year 2010 Comprehensive Plan
on April 15, 1993; and
WHEREAS, the Florida Department of Community Affairs has
adopted Rule 28-20 regarding proposed revisions to the Monroe
County Year 2010 Comprehensive Plan; and
WHEREAS, Administrative Hearings are now underway between the
State of Florida's Department of Community Affairs and Monroe
County regarding provisions of the Comprehensive Plan and the
Land Development Regulations; and
WHEREAS, Mr. Robert C. Apgar, Esq., is Monroe County's legal
representative in those proceedings; NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA THAT:
Section 1. The Board of County Commissioners hereby directs
Mr. Robert C. Apgar, Esq., to cease opposition to that portion of
DCA Rule 28-20 (commencing on page 28 (9) of the rule) amending
the policies currently enumerated 101.4.1 through 101.4.24 under
Objective 101.4 of the Monroe County Comprehensive Plan.
Section 2. The Board of County Commissioners hereby directs
Mr. Robert C. Apgar, Esq., to advocate to the Department of Commu-
nity Affairs and the Hearing Officer in the above referenced
proceedings, the addition of the following Policy 101.4.25 under
Objective 101.4 of the Monroe County Comprehensive Plan:
Policy 101.4.25
In order to preserve the existing community
character and natural environment, Monroe
County shall limit the height of structures
including landfills to a maximum of 35 feet.
Exceptions will be allowed for appurtenances
to buildings, transmission towers, and other
similar structures.
Section 3. The Clerk of the Board is hereby directed to forward
one (1) certified copy of this Resolution to the Division of
Growth Management.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 18th day of January, A.D., 1995.
