Resolution 072-1995 RESOLUTION NO. 072-1995 A RESOLUTION OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, AMENDING RESOLUTION NUMBER 008-1995, WHICH DIRECTED MR. ROBERT C. APGAR, ESQ., LEGAL COUNSEL TO THE BOARD REGARDING THE MONROE COUNTY YEAR 2010 COMPREHENSIVE PLAN, TO CEASE OPPOSITION TO THAT PORTION OF DCA RULE 28-20 AMENDING THE POLICIES CURRENTLY ENUMERATED 101.4.1 THROUGH 101.4.24 UNDER OBJECTIVE 101.4 OF THE COMPREHENSIVE PLAN. Apgar, Esq., is MonrOe ;Cou~' s ~1.egal representative in these proceedings; and WHEREAS, on January 18, 1995, the Board adopted Resolution No. 008-1995, which directed Mr. Robert C. Apgar, Esq., to cease opposition to that portion of DCA Rule 28-20 (commencing on page 28 (9) of the rule) amending the policies currently enumerated 101.4.1 through 101.4.24 under Objective 101.4 of the Monroe County Comprehensive Plan and to advocate to the Department of Community Affairs and the Hearing Officer in the above referenced proceedings, the addition of the following Policy 101.4.25 under Objective 101.4 of the Monroe County Comprehensive Plan: Policy 101. 4.25 In order to preserve the existing community character and natural environment, Monroe County shall limit the height of structures including landfills to a maximum of 35 feet. Exceptions will be allowed for appurtenances to buildings, transmission towers, and other similar structures." AND WHEREAS, the Board wishes to amend Resolution No. 008-1995 so that landfills are excluded from the proposed new Policy 101.4.25 as stated above; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: Section 2 of Resolution No. 008-1995 is hereby amended to read: Section 2. The Board of County Commissioners hereby directs Mr. Robert C. Apgar, Esq., to advocate to the Department of Community Affairs and the Hearing Officer in the above referenced proceed- ings, the addition of the following Policy 101.4.25 under Objec- tive 101.4 of the Monroe County Comprehensive Plan: Policy 101.4.25 In order to preserve the existing community character and natural environment, Monroe County shall limit the height of structures, excludinq landfills, to a maximum of 35 feet. Exceptions will be allowed for appurte- nances to buildings, transmission towers, and other similar structures. All other provisions of Ordinance No. 008-1995 remain in full force and effect. The Clerk of the Board is hereby directed to forward one (1) certified copy of this Resolution to the Division of Growth Man- agement. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 21st day of February , A.D., 1995.
