A RESOLUTION OF THE BOARD OF COUNTY COMMISSION~ ~
OF MONROE COUNTY, FLORIDA, TO THE LEGISLATfV'~ '
DELEGATION REQUESTING THEIR HELP WITH THE FLORIDA.
DEPARTMENT OF TRANSPORTATION AND THE FLORIGAE
DEPARTMENT OF COMMUNITY AFFAIRS TO HELP MONROE.
COUNTY SOLVE THE MORATORIUM PROBLEM ON BIG PI~E
KEY AND TO SECURE SOME RELIEF FROM THE METHODOLOGY
EMPLOYED IN ASSESSING THE ROAD CAPABILITIES DUE TO ITS
INHERENT UNFAIRNESS AS IT AFFECTS BIG PINE
KEY.

WHEREAS, Monroe County's Land Use Plan contains a prohibition on issuing
building permits in the event that any public facilities have fallen below a level of
service required by the Monroe County Code (9.5-292); and
WHEREAS, this section of the Code further requires an annual Public Facilities
Capacity Assessment which is submitted to the Monroe County Board of County
Commissioners and approved by them; and
WHEREAS, the 1994 Monroe County Public Facilities Capacity Assessment
reflected that the levels of service for road facilities in the area known as Big Pine Key
between mile markers 33 and 29.5 are below acceptable levels of service; and
WHEREAS, upon due consideration the Board of County Commissioners of
Monroe County approve this report; and
WHEREAS, as a result of this report Monroe County is now prohibited from
authorizing any development activity on Big Pine Key; and
WHEREAS, it is felt by the Board of County Commissioners that the imposition of
this policy on Big Pine Key is excessively stringent and unfair due to the fact that traffic

on Big Pine Key is encouraged to drive at what would otherwise be excessively slow
speeds in furtherance of the caution exercised on behalf of the Florida Key Deer; and
WHEREAS, the Board of County Commissioners of Monroe County desires to help
the citizens of Big Pine Key with respect to the furtherance of their rather modest
development goals; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, hereby solicits their Legislative Delegation to use their good offices
to request help with the Florida Department of Transportation and the Florida
Department of Community Services in helping Monroe County to solve the moratorium
problem on Big Pine Key and to secure some relief from the methodology employed in
assessing the road capabilities due to its inherent unfairness as it affects Big Pine Key.
BE IT FURTHER RESOLVED BY SAID BOARD, that the Clerk is hereby directed to
forward a certified copy of this resolution to Senator Daryl Jones and Representative
Debbie Horan.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the 15th day of
March , 1995.
