Planning Department RESOLUTION NO. 199-l995 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 98, PARCEL B, PARAISO ESTATES, VACA KEY ,MONROE COUNTY, FLORIDA, APPROXIMATELY MILE MARKER 51. WHEREAS, the property described as the southern one-third of Parcel B, Paraiso Estates, Vaca Key, Section l2, Township 66 South, Range 32 East, Monroe County, Florida, is currently zoned Improved Subdivision; and WHEREAS, the current Land Use district boundar~s whic~ in~icate Iii>> . ~ -- that the property is Improved Subdivision, were no&~~aced in ~;;rror .::':)~,~ c:.... 0 .-""1 ~ - ~ c::: _,..~ with the adoption of the September l5, 1986 Land D5~_elopm~nt '_' C:-;:-, w Regulations, and therefore the subsequent maps wer~'~lso not ~~ -<' . -0 . . -, .::.. c error, as they did follow the previously demarcatBa Subur~n ~ -. U1 Commercial/Improved Subdivision boundaries; and WHEREAS, the staff recommends denial of the requested boundary changes as indicated in Staff Recommendation by Antonia Gerli, Development Review Coordinator, dated May 16, 1995, NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: l) The action of the Planning Director, has determined that the requested boundary change dated May 16, 1995, in Land Use District Map Boundary Interpretation Number 98, is hereby found not to be in conformance with the standards set forth in Section in Section 9.5-3(m) (6), Monroe County Code; and is therefore denied; and that I " 2) The above described property should remain designated as Improved Subdivision as currently indicated; and that 3) The above conclusion of law, is predicated upon the finding of facts and conclusions outlined in the staff recommendation which this Board hereby adopts as its own. 4) The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning Department. 5) The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Community Affairs.
