Regular Meeting
Board of County Commissioners
Wednesday, August 21, 1985
Key Colony Beach
A regular meeting of the Board of County
Commissioners convened on the above date at Key Colony
Beach. Present and answering to roll call were Commissioner
Alison Fahrer, Commissioner John Stormont, and Mayor
Wilhelmina Harvey. Absent from the meeting were
Commissioners William Freeman and Ed Swift. Also present
were Rosalie L. Simmons, Deputy Clerk; Kermit Lewin, County
Administrator; Lucien Proby, County Attorney; Charles
Pattison, Building -Planning -Zoning Director; Andy Hooten and
Bob Smith, County biologists; members of the Press and
Radio; and the general public.
All stood for the Invocation and Pledge of
Allegiance to the Flag.
The Chair declared that a quorum did exist.
Motion was made by Commissioner Fahrer and seconded
by Commissioner Stormont to hold a Public Hearing on the
Budget in Key West at 5:00 P.M. on September 20, 1985.
Motion carried unanimously.
Motion was made by Commissioner Stormont and
seconded by Commissioner Fahrer to hold a Special Meeting of
the Board of County Commissioners at 11:00 A.M. on Monday,
August 26th, at 310 Fleming Street in Key West for the pur-
pose of discussing the fifth and sixth cent gas tax. Motion
carried unanimously.
BOARD OF APPEALS
The Board of County Commissioners sat as the Board
of Appeals. Present were Commissioners Fahrer and Stormont
and Mayor Harvey. Absent from the meeting were
Commissioners William Freeman and Ed Swift. Also present
were Rosalie L. Simmons, Deputy Clerk; Kermit Lewin, County
Administrator; Lucien Proby, County Attorney; Charles
Pattison, Building -Planning -Zoning Director; Andy Hooten and
Bob Smith, County biologists; members of the Press and
Radio; and the general public.
Mr. Joe Miklas, attorney representing Richard R.
Pratt, Jr., addressed the Board concerning his appeal pur-
suant to the Monroe County Board of Adjustment's action on
April 3, 1985, in denying a Dimensional Variance pursuant to
Section 10-101(b) of the Monroe County Code on the property
located in Tract A. FIRST ADDITION TO KNOWLSON COLONY
SUBDIVISION according to the Plat thereof, as recorded in
Plat Book 3, Page 110 of the Public Records of Monroe
County, Florida, being more particularly described by metes
and bounds; located on Atlantic Drive and Ocean Drive; zoned
RU-1. Mr. and Mrs. Charles Schaad addressed the Board. Mr.
Pratt also addressed the Board. Motion was made by
Commissioner Stormont and seconded by Commissioner Fahrer to
adopt the following Resolution upholding the decision of the
Board of Adjustment of Monroe County, Florida, without pre-
judice, and denying the request of Richard R. Pratt to
reverse the decision of the Board of Adjustment of Monroe
County, Florida denying a Dimensional Variance requested
pursuant to Section 10-101(b) of the Monroe County Code.

Roll call vote on the motion was unanimous.

reference.
After lengthy discussion, motion was made by
Commissioner Stormont and seconded by Commissioner Fahrer to
waive the one-year period and allow the applicant to apply
for variance other than the first variance. Roll call vote
was taken with the following results:
Commissioner Fahrer Yes
Commissioner Stormont Yes
Mayor Harvey No
Motion carried.
The Board and Mr. Pattison entered into a
discussion concerning the scheduling of future appeals. No
action was taken.
There being no further business, the meeting was
adjourned.
