A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
REQUESTING FLORIDA DEPARTMENT OF
TRANSPORTATION TO PROVIDE IN THEIR CONTRACT
DOCUMENTS FOR THE USl/SRS/OVERSEAS HIGHWAY
BRIDGE CROSSING JEWFlSH CREEK & LAKE SURPRISE
PROJECT THAT FILL REMOVED FROM PROJECT
LOCATION REMAIN IN MONROE COUNTY.
WHEREAS, the USl/SR5/0verseas Highway Bridge Crossing Jewfish Creek & Lake Surprise Project
will result in the removal of substantial fill to provide for the better flow of water; and
WHEREAS, said project is located entirely within Monroe County, Florida; and
WHEREAS, the Florida Keys are in grave need of fill to elevate sites to meet flood-plain requirements;
and
WHEREAS, in order to provide more efficient and better services to the residents of and visitors to the
Florida Keys, Monroe County has scheduled numerous capital projects, including but not limited to the construction
of five new fire stations, a medical examiner's facility and recreation areas;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, THAT:
1, Monroe County hereby requests the Florida Department of Transportation to provide in their
contract documents for the USl/SR5/0verseas Highway Bridge Crossing Jewfish Creek & Lake
Surprise Project that fill removed from the project site remain in Monroe County for use by
Monroe County for its planned and budgeted capital projects and future purposes as the County
deems fulfills a public need.
2. This Resolution shall become effective upon the date of its adoption herein.
3. The Clerk is directed to mail copies of this resolution to the Secretary of the Florida Department of
Transportation and the Florida Department of Transportation, District 6 Director.

Dear Mr. Kolhage:
This is in response to your letter of May 7, 2004 requestimg the Florida Department of
Transportation to provide Monroe County with the removeq excavated material from the
US II SR 5/0verseas Highway at Jewfish Creek project. · Regretfully, the Department
will not be able to comply with Resolution No. 159-2004 mid give the excavated material
to Monroe County.
Large sections of the roadway project in Monroe COUlty require fill material. In
addition, the two projects in Miami-Dade County, ofthe 18 mile corridor, also require fill
material. The contractor is the owner of the excavated mat rial, as per our specification.
The excavated material is used to offset the cost and need for new fill material on the
project. Any surplus material is disposed of by the oontractor when the work is
completed.
Once a contractor is selected, Monroe County should ~ontact them to discuss and
negotiate this matter. We expect a contractor to be on board by August 2004. Should
