RESOLUTION NO. 297-1995
A RESOLUTION GRANTING CORAL COAST SUBDIVISION
AN EXEMPTION FROM THE BUILDING PERMIT
ALLOCA nON REQUIREMENTS OF MONROE COUNTY
ORDINANCE 16-1992
WHEREAS, the Circuit Court of the 16th Judicial Circuit of Florida has remanded the
August 17, 1994, application of Lamar Louise Curry, for an exemption from the provisions of
Monroe County Ordinance 16-1992, by Partial Final Judgment dated August 8, 1995, in Case
No. 93-20-062-CA-18; and
WHEREAS, the Circuit Court's Judgment requires Monroe County to reconsider said
application pursuant to the laws, regulations, and policies in effect as of the date of said
application; and
WHEREAS, the Circuit Court's Judgment requires Monroe County to reconsider said
application and render a fmal decision within 30 days, i&.., no later than September 7, 1995; and
WHEREAS, as of August 17, 1994, the traffic study submitted by Applicant concluded
that the critical road segment shown in the December 1991 update of the 1989 Post, Buckley,
Schuh & Jernigan, Inc., Transportation Analysis for Monroe County, was located such that
development of the single-family lots at the Coral Coast Subdivision would not shift the critical
road segment, nor increase the traffic volume thereon, and therefore, would not increase overall
County hurricane evacuation time, and Monroe County has decided not to dispute that
conclusion;

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA THAT:
1. The single-family lots of Coral Coast Subdivision, consisting of Lots 1 through
15, according to the Plat of Coral Coast Subdivision recorded at Plat Book 7, Page 55, as
corrected in Plat Book 7, Page 60, of the Public Records of Monroe County are deemed to be
NOT AFFECTED by the building permit allocation provisions of Monroe County Ordinance
16-1992, U 9.5-120-124, Monroe County Code (1995), because the lots are hereby granted the
exemption provided for at ~ 9.5-121(e)(3).
2. The Growth Management Division shall not apply the provisions of~ ~~ 9.5-
120-124 to deny issuance of building permits for construction of residential structures on said
lots, and shall review building permit applications for said lots without regard to the building
permit allocation provisions of ~~ 9.5-120-124. This exemption shall be without regard to the
changes which had been made to date in Monroe County's hurricane evacuation times resulting
from improvements to, or improved management of, the County's road network, since August
17, 1994.

at a regular meeting of the Board held on the 15tltlay of August, 1995, A.D.
