ORDER TO PROVIDE FOR A DATE CER't~~N'fftilf'E:CEMBER 21, 1995 AS THE LATEST lJt.fm"~fFOBtlN N>ff-'~[CATION FOR THE FIRST MONROE COUNTY BUILDING PERMIT. WHEREAS, Monroe County, by and through its Board of County Commissioners, passed and adopted Resolution 210-1994 on July 20, 1994, authorizing and approving a Settlement Agreement between Monroe County and Joseph Farrugia; and WHEREAS, Joseph Farrugia performed timely under the provi- sions of paragraph three (3) of Resolution 210-1994 and applied for a plat abandonment for the property known as Coral Harbor; and WHEREAS, Monroe County, by and through its Board of County Commissioners, passed and adopted Resolution 267-1994, abandoning the plat on September 21, 1994; and WHEREAS, under the provisions of Resolution 210-1994, Joseph Farrugia was to apply for a Monroe County building permit by not later than one (1) year after the plat abandonment which permit was to be for construction of infrastructure, including aU. S. Highway 1 driveway connection and driveway for ingress and egress for the property known as Coral Harbor; and WHEREAS, confusion has arisen over the permitting standards to be applied by the Florida Department of Transportation and Monroe County over permitting of the driveway connection and driveway under which Joseph Farrugia was to begin construction, which has resulted in a delay of the permit for the driveway; and WHEREAS, a delay in beginning construction under the terms of Resolution 210-1994 was caused by circumstances outside the con- trol of Joseph Farrugia; and WHEREAS, there now exists a possible partnership by one (1) or more hospital facilities for siting a nursing home facility on the Coral harbor property, which will serve to provide needed nursing home facilities for the residents of Monroe County; and WHEREAS, it is in the best interests of Monroe County to provide for the health, safety and welfare of its citizens and to provide for the establishment of locally situated long-term nurs- ing care facilities; and WHEREAS, Joseph Farrugia timely applied prior to September 21, 1995 to amend the provisions of paragraph 2 of BOCC Resolu- tion 210-1994 to provide for a date certain of September 21, 1996 as the latest date for application for the first Monroe County building permit; and WHEREAS, on this date, the Board of County Commissioners has approved an amendment to paragraph 2 of BOCC Resolution 210-01994 to provide for a date certain of December 21, 1995 as the latest date for application for the first Monroe County building permit; NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT The first sentence of paragraph 2 of Resolution 210-1994 is hereby amended to read "Application for a Monroe county building permit shall be made no later than December 21, 1995." All other provisions of Resolution 210-1994 shall remain in effect. The Clerk of the Board is hereby directed to forward one (1) certified copy of this Resolution to the Division of Growth Man- agement. PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the 21st day of September A.D., 1995.
