Planning Department 407 -1995 A RESOLUTION CONFIRMING THE ADMINISTRATIVE BOUNDARY INTERPRETATION OF THE INTERIM PLANNING DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY INTERPRETATION NUMBER 99, A PARCEL OF LAND IN SECTION 28, TOWNSHIP 61 SOOTH, RANGE 39 EAST ON KEY LARGO, AND FURTHER, DE- SCRIBED BY METES AND BOUNDS (EXHIBIT A) MON- ROE COUNTY, FLORIDA, APPROXIMATELY MILE MARK- ER 100 . \.0 -" \J1 r""', C"I CJ fTl UT' C":l I ':) U1 .......... ~TJ WHEREAS, the property described as the southern -0 r~ one-t~rd~f ..;::::,. ~;) Ul ,'] Exhibi t A. the parcel and further described by metes and bounds in (attached), Key Largo,Monroe County, Florida, is currently zoned SC, and the northern two-thirds is currently zoned IS; and WHEREAS, the current Land Use district boundaries which indicate that the property is zoned SC, were placed in error with the adop- tion of the September 15, 1986 Land Development Regulations, and therefore the subsequent maps were also in error, as they did not follow the previously demarcated SC boundary; and WHEREAS, the staff recommends approval of the boundary changes as indicated in the Staff Recommendation by Antonia Gerli the Interim Planning Director, dated November 1, 1995; and NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: 1) The action of the Interim Planning Director, who has deter- mined that the requested boundary change dated September 14, 1995 boundary change in Land Use District Map Boundary interpreta- tion Number 99, is hereby found to be in conformance with the standards set forth in Section 9.5-3(m), Monroe County Code; and is therefore approved; and that 2) The above described middle one-third of the property should have been originally designated as SC and not IS as currently indicated, accordingly the correct land use district boundary is set forth on Exhibit B (attached); and that 3) The above conclusion of law, is predicated upon the finding of facts and conclusions outlined in the staff recommendation which this Board hereby adopts as its own. 4) The Clerk of the Board is hereby directed to forward a certified copy of this Resolution to the Monroe County Planning Department. 5) The Clerk of the Board is hereby directed to forward a certified copy of this resolution to the Florida Department of Community Affairs.
