Ordinance 005-1986 Fire Marshal ORDINANCE NO. 005 -1986 AN ORDINANCE AMENDING ORDINANCE NO. 034-1985 PERTAINING TO THE USE OF FIREWORKS IN MONROE COUNTY, FLORIDA, BY AMENDING SECTION 2 OF ORDINANCE NO. 034-1985; PROVIDING FOR SEVER- ABILITY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SAID CONFLICT; PROVIDING FOR INCLUSION IN THE MONROE COUNTY CODE OF ORnINANCES; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Section 2 of Ordinance No. 034-1985 is hereby amended to read as follows: "The Fire Marshal shall determine that the appli- cant has purchased a liability insurance policy of not less than $500,000 per person or $1,000,000 per inci- dent for all claims, that the County is named as a co-insured, that the County will be held harmless from any liabilities relative to the display of fireworks under said permit, and that the County will be afforded a defense to any action." Section 2. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. All ordinances or parts of ordinances in con- flict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall ta.ke effect immediately upon receipt of official notice from the Secretary of State of the State of Florida that this Ordinance h~s been filed with said Office.
