Ordinance 009-1986 Charles Pattison, Director Building, Planning & Zoning ORDINANCE NO. 009-1986 AN ORDINANCE PROVIDING FOR A TWO HUNDRED FIFTY ($250.00) DOLLAR APPLICATION FEE FOR CERTAIN STRUCTURES PAYABLE AT THE TIME A BUILDING PERMIT IS APPLIED FOR; PROVIDING THAT A BUILDING PERMIT MUST BE PICKED UP WITHIN A CERTAIN TIME AFTER IT IS READY TO BE ISSUED OR IT SHALL BE DEEMED ABANDONED; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES OF MONROE COUNTY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a large increase in the number of persons applying for building permits has occurred recently in Monroe County straining the capacity of the County to process the same; and WHEREAS, it is desired to immediately create a funding device to provide for additional fee~ at the time a building permit is applied for to help defra~ the cost of regulating building construction in Monroe County; and WHEREAS, the need for a Two Hundred Fifty ($250.00) Dollar u~-front application fee is so immediate, given the current crush of applications, that an emergency exists; BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Sec. 6-16.1(5) (a) (1) of the Monroe County Code is hereby amended to read as follows: "(5) Permit Fee Schedule shall be as follows: (a) Building permit fees: ---'- 1. (a) New buildings (including balconies, additions, garages and accessory buildings): For each 100 square feet of area, or frac- tional part thereof, of enclosed space . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .. $18.00 For each 100 square feet of area, or frac- tional part thereof, of areas enclosed on 2 sides or less .......... ......... 9.00 Minimum fee .......................... 18.00 (b) Building permit applicants for new commercial buildings, multi-family buildings, duplexes and single family shall also pay a nonrefundable Two Hundred Fifty ($250.00) Dollar fee at the time of filing for a building permit. If the application is approved, the fee shall be deducted from any other amount which may be due and owing under the other terms of Section 6-16.1(5)." Section 2. Section 6-16.1(5) (a) (23) of the Monroe County Code is hereby created to read as follows: "23. All permit fees in this section except those described in 6-16.(5)(a)(1)(b) shall be due and payable at the time the building permit is ready to be issued. No building permit shall be issued until all such fees are paid." Section 3. Section 6-16.1 (5) (a) (24) of the Monroe County Code is hereby created to read as follows: "24, Following notification by the Building Official by registered mail return receipt requested, to the permit applicant, that the permit is ready to be issued, and the ap- plicant fails to pick up the permit and pay the requisite fees within 30 days of the receipt of notice, then that permit shall be deemed abandoned and of no effect. The applicant shall then have to reapply for the permit paying all the fees in effect at the time of reapplication. The applicant shall also comply with all building codes and all land use regulations in effect at the time of reapplication." Section 4. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. -2- Section 5. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 6. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 7. This ordinance shall take effect innnediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said office.
