A RESOLUTION REMANDING PROPOSED MAP AMENDMENT
FOR PART OF LOT 1 AND ALL OF LOTS 2 AND 3, BA YWOOD
SUBDIVISION, TO THE MONROE COUNTY PLANNING

WHEREAS, a public hearing was held by the Board of COunty',

Commissioners on the proposed map amendment to the Land Use Gistricr~

Map for applicants Sutton, Micelli, and Marsteller who requested a map
amendment from UR to RV for part of Lot 1 and all of Lots 2 and 3,
Baywood Subdivision, Section 11, Key Largo; and
WHEREAS, it appears from the record, including testimony given at
the public hearing before the BOCC, that no justification to rezone the
Sutton parcel has been established, and that the characteristics of the
Micelli and Marsteller parcels may well be more consistent with SC than
with RV; and
WHEREAS, the Planning Commission should have the opportunity to
consider, and the public should have notice and input on the issue,
whether SC zoning would be appropriate to the Micelli and Marsteller
parcels, separate from the Sutton parcel; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA that the applications which are the subject of
Monroe County Planning Commission Resolution No, P55-95 are hereby
- REMANDED to the Planning Commission for separate consideration of the
appropriate land use designation for each applicant's parcel, with due
consideration being given to whether SC designation is appropriate to the
Micelli and Marsteller parcels,
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held on the
21st day of November AD, 1995.
