006 -1987
AN ORDINANCE CREATING AN EMERGENCY MEDICAL
. SERVICE ADVISORY COUNCIL FOR MONROE COUNTY;
PROVIDING THAT THE SAME IS AN EMERGENCY IN
THAT IT EFFECTS THE LIFE, PROPERTY, WELFARE,
AND HEALTH OF THE CITIZENS OF MONROE COUNTY;
PROVIDING FOR THE COMPOSITION OF SAID COUNCIL
AND FOR THE DUTIES THEREOF; PROVIDING FOR THE
TERM OF THE VARIOUS MEMBERS OF SAID COUNCIL;
PROVIDING FOR THE EX OFFICIO MEMBERSHIP
THEREOF; PROVIDING FOR THE REPLACEMENT OF
SAID MEMBERS AND FOR THE REPORTING BACK TO
THE MONROE COUNTY COMMISSION FROM TIME TO
TIME AND TO ADOPT RULES CONCERNING THE
OPERATION OF SAID COUNCIL AND ITS MEETINGS;
PROVIDING FOR SEVERABILITY; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SAID CONFLICT;
PROVIDING FOR INCLUSION IN THE MONROE COUNTY
CODE OF ORDINANCES; AND PROVIDING AN EFFEC-
TIVE DATE.
WHEREAS, Monroe County is in immediate need of a medical
services advisory council; and
WHEREAS, because of the problems attendant to health care in
Monroe County, including trauma related injuries which have
become more pressing and distressing, it is deemed by the Monroe
County Commission that said need is an emergency and consequently
this ordinance is directly related to the health, welfare, and
safety of the people of Monroe County; now, therefore
BE IT ORDAINED BY THE MAYOR AND COUNTY COMMISSION OF MONROE
COUNTY as follows:
Section 1.
That an Emergency Medical Services Advisory
Council is hereby created for Monroe County, Florida.
Section 2.
That an emergency is hereby declared and the
matters herein considered affect the health, welfare and safety
of the citizens of Monroe County.
Section 3.
That the membership of said Council shall be
composed of fifteen (15) members all being citizens of Monroe
County.
It is provided that eight (8) members thereof shall
serve for a period of two (2) years and seven (7) shall serve for
a period of one (1) year it being provided that a like number of
appointments shall be yearly made by the County Commission for
the termination for each term vacated. Terms shall commence on
January 1, of each year with seven of the original appointees to
serve until January 1, 1988.
Section 4. That the Monroe County Commission shall
appoint yearly a chairman of said Council who shall serve as the
presiding officer and that person shall act as said Council's
liaison who shall maintain continuous contact with said County
Commission. It is also provided that in the event of a vacancy
on said Council that a successor shall be appointed by the Board
of County Commissioners for the balance of said term.
Section 5. No compensation shall be paid to Council
members, nor shall there be any provision for per diem and travel
expenses, except and when a representative of said Council shall
be required to travel outside of Monroe County for the purpose of
representing said County and/or Council at any official function.
In that event, such travel and expenses must be considered for
approval by the County Commission upon request.
Section 6. The representation on said Council shall
require the following qualifications: there shall be two (2)
licensed physicians who are "medical directors" as defined in
Section 401.23 (15) F. S. or whose medical practice is closely
related to emergency medical services; two (2) emergency medical
service administrators, one of whom is employed by Monroe County;
one (1) State certified paramedic; one (1) State certified
emergency medical technician; one (1) emergency medical services
educator; one (1) emergency nurse; two (2) hospital administra-
tors; two (2) persons at large who are connected with emergency
medical services; two (2) lay persons who are in no way connected
with emergency medical services, one of whom is a representative
of the elderly; and one (1) representative of a fire service
providing medical first response type service.
Section 7. It is hereby provided that ex officio members
shall include the following: representatives from the County
Administrator's office, the County Attorney's office, the Depart-
ment of Emergency Services, the Department of Social Services,
and the Monroe County Health Department. It is specifically

understood that said ex officio members shall have no vote but
may participate in discussion at the pleasure of the chairman of
said Council.
Section 8. It is hereby understood and provided that all
members of said Council as set forth in Section 6. above shall
serve at the pleasure of the Commission and may be discharged
accordingly.
Section 9.
(A) The Council hereby created shall meet no less than six
(6) times annually and all such meetings shall be recorded and
documented and the proceedings therein undertaken shall be
permanently recorded;
(B) The Council shall hold all their meetings in public at
the call of the chairman or upon written request of five (5)
members of this Councilor at the call of the Director of Emer-
gency Services.
(C) For there to be a quorum so as to transact business it
will be necessary for a majority of the Council sitting at that
time to be present.
(D) All the minutes of meetings shall be recorded by the
Council and a file thereon shall be maintained in the Emergency
Services Department.
Section 10. The chairman shall present a report of the
doings and actions of this Council annually and documented in
compliance with this ordinance. Such report can also contain the
doings and accomplishments of the Emergency Medical Services
Advisory Council for the preceding year.
Section 11. It is provided that the Board of County
Commissioners of Monroe County shall adopt rules to implement
this ordinance and that said rules shall serve as the formal
operating procedure for the Emergency Medical Services Advisory
Council.
Section 12. If any section, subsection, sentence, clause or
provis ion of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.

Section 13. All ordinances or parts of ordinances in con-
flict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 14.
The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of Monroe
County, Florida, as an addition or amendment thereto, and shall
be appropriately renumbered to conform to the uniform numbering
system of the Code.
Section 15. This Ordinance shall take effect when a cer-
tified copy of this Ordinance has been accepted by the postal
authorities of the Government of the United States for special
delivery by registered mail to the Secretary of State of the
State of Florida.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 17th day of March, A.D., 1987.
