Ordinance 014-1987 County Commission ORDINANCE NO. 014 -1987 AN ORDINANCE CREATING THE MONROE COUNTY TELEVISION TRANSLATOR BOARD; PROVIDING FOR MEMBERSHIP AND QUALIFICATIONS ON SUCH BOARD; PROVIDING FOR THE ORGANIZATION OF THE BOARD; PROVIDING FOR THE FUNCTIONS OF SAID BOARD; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HERE- WITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFEC- TIVE DATE. WHEREAS, Florida Statutes, Section 125.01 (1) (w) gives the Board of County Commissioners of Monroe County the power to perform any acts not inconsistent with law which are in the common interest of the people of the county, and exercise all powers and privileges not specifically prohibited by law. WHEREAS, it is the purpose of this ordinance to establish a Monroe County Television Translator Board and to operate and maintain television translator services within Monroe County, now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISS lONERS OF MONROE COUNTY, FLORIDA: Section 1. It is hereby declared that the purpose and intent of the Board of County Commissioners through this ordi- nance is to create and establish a television translator board for the purpose of obtaining the benefits of accurate, comprehen- sive information, advice and counsel concerning all matters relating to television translators. This ordinance shall not be construed as delegating to such advisory board or its members any power or authority of a governmental, legislative or administra- tive nature beyond those specifically enumerated herein, Section 2. There is hereby created and established in Monroe County, Florida a board to be known as the Monroe County Television Translator Board. Section 3. The Monroe County Television Translator Board shall consist of five (5) members, one of each whom shall be appointed by each member of the Board of County Commissioners of Monroe County. Each member shall be a resident and elector of Monroe County; and shall possess a reputation for integrity, responsibility, civil accomplishment and professional or business ability. The Board shall at all times consist of at least two persons professionally engaged in the television translator reception equipment installation business, so as to reflect reception requirements of the system, and one private citizen, who shall be representative of the general public dependent upon receiving the translator signal. No Board member shall receive compensation for his services as a member of such Board. At no time shall more than two members be from an identical geograph- ical area as represented by reception areas formed by the Key Largo transmitter tower coverage, the Is1amorada transmitter tower coverage, the Grassy Key transmitter tower coverage, the Summer1and Key transmitter tower coverage or the Key West trans- mitter tower coverage. Terms of the members of this Board shall be staggered so as to assure continuation of Board activities, but in no event shall a term be longer than three years. Section 4. Any member of the Board who ceases to be a qualified elector, resident, or who becomes a candidate for public office, shall immediately forfeit his office. Any member may be removed from office with cause by a majority vote of the Board of County Commissioners. Section 5. The Board shall elect a Chairman and such other officers as may be deemed necessary or desirable, who shall serve at the pleasure of the Board. A majority of the members of the Board shall constitute a quorum. A maj ority vote of the quorum present at any meeting shall be sufficient to enable taking any action. The Board shall meet normally at a location accessible to the public. Special meetings of the Board may be called by the Chairman, by written notice signed by three (3) members of the Board, or by action of the Board at any meeting, general or special. The Board may further adopt such rules of procedure and elect such other officers as it may deem necessary. Section 6. The Monroe County Television Translator Board shall have the following duties, functions and responsibilities: 2 (1) Serve in an advisory capacity to the Board of County Commissioners and the County Administrator with respect to all matters pertaining to the Monroe County Television Translator System; (2) Furnish information, feasibility, advice, and counsel to the Board of County Commissioners with respect to the appro- priate means and methods by which adequate television broadcast- ing services may be provided to all residents of Monroe County; (3) To evaluate bids before acceptance and make recommenda- tions to the Board of County Commissioners of Monroe County for the award of contracts for: the design and construction of the system; its operation and maintenance; its progressive improve- ment; and, upon award of such contracts by the Board of County Commissioners, shall supervise and administer their execution; (4) Make continuing studies of all existing and future needs of the County, with respect to improving and developing the services provided to the public by the translator system facil- ities; (5) Review the financial position of the system, make reports, and through research efforts, obtain information regard- ing financing through matching funds, public finance, grants, etc. (6) Keep constantly aware of public broadcasting standards, trends, regulations, and legislation; (7) Formulate or recommend actions to raise the quality of service, utilize professional and financial assistance from State, National and other sources, and evaluate such developments as they occur, to take advantage of whatever sources may become available to improve the services that can be made available to the citizenry by the television translator system facilities; (8) Review with the operating and maintenance personnel the current and projected system needs, programs, plans and policies; (9) Prepare reports and recommendations to the Board of County Commissioners related to budgetary, income supplement potentials, and other matters related to financial support of the operation of the system; 3 (10) Establish, promote, and participate in a planned public relations program for the television translator system; (11) Perform and carry out such other duties and functions of and advisory nature as may be assigned by the Board of County Commissioners; and, (12) File an annual report to the County Government on the status of the Monroe County Television Translator System immedi- ate1y prior to the expiration of the term of the Advisory Board, and such supplemental reports at such other times as the Advisory Board deems proper. Section 7. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 8. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 9. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 10. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
