Ordinance 019-1987 ORDINANCE NO. 019 -1987 AN ORDINANCE OF MONROE COUNTY, FLORIDA, DECLARING THAT AN EMERGENCY EXISTS AND WAIVING NOTICE BY A FOUR-FIFTH' S VOTE; AMENDING CHAPTER 12 OF THE MONROE COUNTY CODE OF ORDINANCES ENTITLED "OCCUPATIONAL LICENSE TAXES AND REGULATIONS BY THE PLACING OF A TEMPORARY MORATORIUM UPON THE ISSUANCE OF NEW MOBILE VENDORS AND PEDDLERS OCCUPATIONAL LICENSES UNDER SECTIONS 12-48 AND 12-52 OF SAID CHAPTER FOR A PERIOD OF NINETY (90) DAYS; PROVIDING FOR EXCEPTION FROM SUCH MORATORIUM FOR THOSE PERSONS APPLYING FOR PEDDLERS LICENSES TO OPERATE MOBILE REPAIR OR APPLIANCE SERVICE BUSINESS NOT INVOLVING THE SALE OF MERCHANDISE; PROVIDING FOR SEVER- ABILITY; PROVIDING FOR REPEAL OF ALL ORDINAN- CES OR PARTS THEREOF IN CONFLICT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, that: Section 1. An emergency is hereby declared and notice waived by a four-fifth's vote. Section 2. Sections 12-48 and 12-52 of Chapter 12 of the Monroe County Code of Ordinances entitled "Occupational License Taxes and Regulations" is hereby amended to provide that: A. A moratorium on the issuance of new occupa- tional licenses for mobile vendors and peddlers seeking occupa- tional licenses under Sections 12-48 and 12-52 of the Monroe County Code of Ordinances shall be in effect for a period of ninety (90) days from the effective date of this Ordinance. B. This moratorium shall not be construed to prohibit the issuance of occupational licenses to those persons who hereafter apply for such licenses to undertake service related occupations, such as mobile appliance repair and service, including such occupations as television, kitchen or household appliances, electronic devices and their appurtenances, and motor vehicle and vessel repair under Sections 12-48 and 12-52 of the Monroe County Code of Ordinances. The incidental sale of parts necessary for repair of such items shall not change the basic character of such service oriented businesses. Section 3. If any section, subsection, sentence, clause or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. Section 6. This Ordinance shall take effect when a copy has been received by the postal authorities of the Government of the United States for special delivery by registered mail to the Department of State, State of Florida.
