ORDINANCE NO. 029 -1987
AN ORDINANCE LEVYING IN ALL OF MONROE COUNTY,
A ONE CENT SALES TAX ON TAXES PAID PURSUANT
TO CHAPTER 212, LAWS OF FLORIDA; PROVIDING
FOR THE DISTRIBUTION OF FUNDS SO COLLECTED
AMONG THE VARIOUS MUNICIPALITIES AND THE
COUNTY; PROVIDING THAT THE TAX SHALL BE
COLLECTED COMMENCING ON JANUARY 1, 1988 FOR A
PERIOD OF FIVE YEARS; PROVIDING FOR THE
EXPENDITURE OF THE FUNDS COLLECTED ON CERTAIN
CAPITAL INFRASTRUCTURE PROJECTS THE LIVES OF
WHICH WILL EXCEED FIVE YEARS; PROVIDING THAT
THE FUNDS RAISED BY THIS ORDINANCE SHALL NOT
BE USED TO REDUCE AD VALOREM TAXATION OR ANY
USER FEES INCLUDING IMPACT FEES; PROVIDING
FOR THE PLEDGING FUNDS SO RAISED FOR BONDED
INDEBTEDNESS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE MONROE COUNTY
CODE OF ORDINANCES; PROVIDING FOR THE REPEAL
OF ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT WITH THIS ORDINANCE; AND PROVIDING
FOR REFERENDUM APPROVAL BEFORE THE ORDINANCE
MAY TAKE EFFECT.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
The funds collected pursuant to this ordi-
nance shall be distributed among the various municipalities and
the county according to the formula set forth in F.S. 218.62 and
shall be at the following percentages:
69.7413117- Monroe County
28.8836457- City of Key West
1.2526467- City of Key Colony Beach
0.1223987- City of Layton
Section 2.
The one cent sales tax authorized by this
ordinance shall be collected commencing on January 1, 1988, and
shall sunset on December 31, 1993, unless extended pursuant to
general law.
Section 3.
The funds so collected, and interest accrued
thereto, shall be expended within the unincorporated areas of
Monroe County and the various municipalities, in the specific
formula contained in F.S. 218.62 or in the case of a negotiated
agreement with another county, within another county, for infra-
structure as that term is defined in F.S. 212.055(3)(f)(2) and
which shall include the following projects:
MONROE COUNTY
Plantation Key Jail/Administration Complex;
State Attorney Offices at Jackson Square in Key West;
Key Largo (K-Mart) Tradewinds Library;
Acquisition of additional landfill space for service to the
middle and upper keys;
State Road C-905-A reconstruction;
Marathon county administration building;
Stock Island recreational park and other unincorporated
area recreational parks;
Marathon airport improvements - runway/ramp/
parking/terminal expansion;
Sheriff's administration building and jail upgrade at
Marathon;
Key West airport improvements - runway/ramp/parking/
terminal expansion;
Key West county office building;
Renovation of the courthouse in Key West;
Administration building at Key West.
City of Key West
Parking garages and land acquisition therefor;
fire station;
storm sewer;
White Street pier, Rest Beach, Smathers Beach, South Beach
and beach maintenance in general;
restoration of the old and new City Hall;
dock construction at Garrison Bight;
seawall reconstruction;
salt pond and park acquisition and development of City
parks;
storage facilities for city maintenance vehicles;
Refurbishment of Wickers Field and other parks and
recreation facilities.
City of Key Colony Beach
Additional parking facilities at City Hall;

City Hall addition with emergency control center;
land improvement to City entrance, park area due to
damage done during state road construction;
public tennis courts on City-owned recreation areas.
City of Layton
Road and bridge repair;
rip rap;
sheriff substation;
administrative offices.
Nothing contained in this section, however, shall be con-
strued to prohibit the hiring of out-of-county or out-of-city
contractors or subcontractors or construed to prohibit the
purchasing of any necessary material outside of the county or the
various municipalities.
Section 4. No funds collected pursuant to this ordi-
nance, or any interest accrued thereto, shall be used to replace
any user fees, including impact fees, or to reduce ad valorem
taxes in existence prior to the levy of the sales tax created by
this ordinance.
Section 5. The County and the various municipalities may
pledge the funds raised pursuant to this ordinance for the
purpose of servicing new bond indebtedness incurred pursuant to
general law. All bond proceeds, less administrative fees and
expenses, may only be utilized for the purposes set forth in
Section 4 of this ordinance. Bonds shall not be issued more
frequently than once per year. The County and any, or all, of
the various municipalities may join together for the issuance of
such bonds.
Section 6. If any section, subsection, sentence, clause
or provision of this ordinance is held invalid, the remainder of
this ordinance shall not be affected by such invalidity.
Section 7. All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed to the extent of
such conflict.
Section 8. The provisions of this ordinance shall be
included and incorporated in the Code of Ordinances of the County

of Monroe, Florida, but only if the ordinance is approved by the
electorate voting in the referendum election required by Section
10.
Section 9. This ordinance shall take effect on January
1, 1988, contingent upon the approval of a maj ori ty of the
electors voting in a city and county-wide referendum election on
whether to impose the sales tax. Such referendum election shall
be held on October 6, 1987, and the referendum question posed on
the ballot shall be in substantially the following form:
Additional One Cent Sales Tax Within All Of
Monroe County.
Should there be levied, for a period of five
years within the unincorporated areas of
Monroe County, Florida, and the cities of
Layton, Key Colony Beach and Key West, an
additional one cent sales tax which shall be
used for the construction or reconstruction
of capital facilities such as: recreational
facilities, courthouses, parking, offices,
landfills, roads, bridges, airport improve-
ments, libraries, piers, auditoriums, rip
rap/seawalls, storm sewers, and police/fire
facilities?

If this ordinance is approved by the voters in the referen-
dum election required by this section, the Florida Department of
Revenue shall be notified as soon as possible but, in any event,
no later than November 13, 1987.
Section 10. A copy of this ordinance shall also be sent
to the Office of the Secretary of State, State of Florida, but
acknowledgment of receipt by that Office shall not any way alter
the effective date described in Section 9.
