AN ORU1NANCE AMENDING SECTIONS 1-101 AND 102,
MONROE COUNTY LAND DEVELOPMENT REGULATIONS,
IN ORDER TO PROVIDE THAT CHAPTER TWELVE,
IMPACT FEES, APPLY IN THE CITIES OF KEY
COLONY BEACH AND LAYTON TO THE EXTENT
AUTHORIZED BY ARTICLE 8, SECTION l(f),
FLORIDA CONSTITUTION; AND PROVIDING FOR AN
EFFECTIVE DATE.

MONROE COUNTY, ~LORIDA, as follows:
Sect~on 1.
Sections 1-101 and 1-102(A) are hereby amended
to read as tollows:
Sec. 1-101.
Purpose.
It is the purpose of this Volume ot the
Comprehens i ve Plan, the Land Deve lopmen t Regulations,
to establ~sh the standards, regulations and procedures
for review and approval of all proposed development ot
property in un~ncorporated Monroe County, and the
cities of Key Colony Beach and Layton to the extent
provided in Section 1-102(A) ot these regulations, and
to provide a development review process that will be
comprehensive,
consistent,
and efficient
~n
the
implementat~on of the goals, policies and standards of
the Plan.
in order to foster and preserve public health,
safety, comfort and welfare, and to aid in the
harmonious, orderly, and progressive development ot the
unincorporated areas of Monroe County, and the cities
of Key COlony Beach and Layton as hereinafter provided,
~t is the intent of this Volume that the development
process in Monroe County be efficient, in terms ot time
and expense, etfective, in terms ot addressing the
natural resource and public fac~l~ty implications of
proposed development, and equitable, in terms of
consistency
with
establ~shed
regulations
and
procedures, respect for the r~ghts of property owners,
and considerat~on ot the interests of the citizens of
Monroe County.
The Board of County Commissioners deems it to be
in the best public interest for all development to be
conceived, des~gned, and built in accordance with good
planning and design practices and the minimum standards
set forth herein.
1 t is turther the purpose ot this ordinance to
enable the County and the cities of Key Colony Heach
and Layton to enter into any inter local agreement or
agreements to implement the purposes of this ordinance.
Sec. 1-lU2. Applicability.
A, General Applicability. The prov~s~ons of
this Volume shall apply to all land ~n un~ncorporated
Monroe County. In addition, the provisions of Chapter
12 shall apply within the cities of Key Colony Beach
and Layton to the extent authorized by Art. ~, Sec.
(1) (f), Florida Constitution. All development of
whatever type and character, whether permitted as of
right or as a conditional use, shall comply with the
development standards and the environmental design
criteria set forth in Chapter Y hereof. No development
shall be undertaken without prior approval and issuance
of a development permit under the provisions ot this
Volume and other applicable laws and regulations. The
applicability of Chapter 12 of this volume shall begin
at such time as an inter local agreement pertaining to
said Chapter lL ~s ~n effect, and shall continue
thereatter until such time as such inter local agreement
is terminated.
Sect~on 2. Incorporation into the Monroe County Development
Regulations. If approved by the state land plann~ng agency, this
amendment shall be incorporated ~nto and made a part of the
Monroe County Land Development Regulations.
Section 3. Ettective Date. This ordinance shall be filed
with the Secretary of State, State of Florida, but shall not take
effect until approved by the state land planning agency pursuant
to F.S. 380.0552(Y).
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held

Tuesday, October 20, 1987 at 3:00 P.M. at the Elk's Club,
Tavernier, Monroe County, Florida, the Board of County
Commissioners of Monroe County, Florida, intends to consider the
adoption of the following County ordinance:

proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
