Ordinance 045-1987 Commissioner Mike Puto ORDINANCE NO. 045-1987 AN ORDINANCE OF THE BOARD OF COUNTY COMMIS- SIONERS OF MONROE COUNTY, FLORIDA, PROVIDING FOR A LIFE SAFETY PLAN REVIEW FEE FOR THE MONROE COUNTY FIRE MARSHAL BY ADDING A NEW SECTION TO CHAPTER 6.6 OF THE STANDARD FIRE PREVENTION CODE, AS AMENDED; PROVIDING FOR REPEAL OF LAWS AND ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 20-1984, ~l, created the Monroe County Fire Marshal's Office. WHEREAS, Florida Statutes Chapter l25.0l(1)q authorizes Counties to establish municipal service taking units for the purpose of, inter alia, providing fire protection and the estab- lishment of reasonable fees to pay for that service; and WHEREAS, Ordinance No. 20-1984, ~l authorizes the Monroe County Fire Marshal or his representatives to review plans for construction, alteration, or remodeling of new or existing buildings excluding single family homes. WHEREAS, Monroe County Commissioner Mike Puto has recommend- ed, and it is desirable, that the funding for these activities be provided by the persons, firms, or corporations benefiting from such services; and WHEREAS, all funds generated from these fees will only be used to off-set those costs assoctated with the fire plans review and inspection process; and WHEREAS, the adoption of this ordinance will be in the public interest by providing a mechanism by which to fund this essential function of County government. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: Section 1. Section 1.04 of the Standard Fire Prevention Code as amended and adopted of Ordinance No. 20-1984, ~ 1 is hereby amended to read as follows: 1.04 Responsibility. A. The Fire Marshal of Monroe County shall be respon- sible for the enforcement of the Code and all State Laws under his jurisdiction, within the operational purview of Ordinance No. 20-1984, ~l pertaining to the prevention, investigation and suppression of fires. Hereafter, in the Code, where the term Fire Official appears, it shall mean the Fire Marshal or his authorized representatives. B. All plans for construction, alteration or remodel- ing of any new or existing buildings, including the installation, modification or removal of any system shall be reviewed by the Fire Marshal for evidence of compliance with this Code. If the plans submitted for review are found not to be in compliance with this Code, the Fire Marshal shall give such reasons for rejection in writing to the applicant. The Fire Marshal may require tests or other investigations to be conducted by an agency satisfactory to the jurisdiction when an appliance, device, equipment or system intended for installation does not specifically meet the requirements of this Code. Such tests or investigations shall be based upon nationally accepted test standards or principles. C. A letter of Fire Code Compliance or noncompliance shall be issued by the Fire Marshal to the Building Official prior to the Building Official issuing a Certificate of Occupancy for the premises for which a building permit has been issued. D. Plan review and Inspection Fees (1) Purpose The purpose of this paragraph D is to provide a means by which to fund costs associated with the Monroe County Fire Marshal's plan review and inspection services. The fee schedule set forth herein is intended to permit the fire preven- tion bureau of Monroe County Fire Marshal's Office to offset the costs of the services through a user fee. (2) Scope The provisions set forth in this Section shall apply to all construction for which the Monroe County Fire Marshal is responsible for, as provided for in Ordinance No. 20-1984, ~l, as have been or may be amended. 2 (3) Fees (a) A fee is prescribed in Paragraph (b) and (c) of this paragraph (3) shall be paid at the time of application for a building permit. (b) Review fees shall be based on the estimated value and calculated at the following percentage rate: 0.2% $0.00 - 100,000.00 plus, .1% $100,001.00 - $500,000.00 plus, .05% $500,001.00 - 1,000,000.00 plus, .025% $1,000,001.00 - and up (or fraction thereof) (c) A flat fee of $200.00 shall be paid for the review of each duplex, tri-plex or four-unit residential struc- ture. (d) The minimum fee shall not be less than $10.00. (e) There shall be no additional charge for those inspections established by the Monroe County Fire Marshal or his authorized representative to ensure that the work is in accor- dance with this Monroe County Fire Code. A reinspection fee of $25.00 shall be charged for reinspection which may be made due to the fact that the work is not ready as specified at the time of schedule inspection, because the work did not meet the Code, or for any reason caused by the applicant which requires an addi- tional trip to the job site by the Inspector. (4) Pre-Review A fee ot $50.00 will be charged for a pre-review of drawings or specifications. This amount may be deducted from the actual fee if a permit evidencing approval under this Section 1.04 is obtained within eight months from the date of pre-review. Should a permit not be obtained, this fee is non-refundable. (5) Plan Revisions A fee of not less than $10.00 nor more than the lesser of $125.00 of the original fee shall be charged for 3 revisions to plans and specifications which require a subsequent review once a permit is issued. This fee shall be as determined by the Monroe County Fire Marshal or his authorized representa- tive and shall be based upon the time spent by the Plan Reviewer and Department personnel in re-review of the plans and specifica- tions. It shall be uniformly applied. (6) Water Flow Tests A fee of $50.00 shall be assessed for water flow tests performed by Monroe County Fire Marshal's Office. (7) Civil Drawings A fee of $25.00 shall be assessed for any drawing reviewed by Monroe County Fire Marshal, including civil drawings, for work for which a building permit is not issued. (8) Refunds Refunds for any fee which exceeds the amount of $100.00, may be requested. The refund shall be in the amount of 70% of the amount paid over $100.00. The refund request must be in the form of a letter submitted to M.C. Fire Marshal containing the permit number and the reason(s) such refund is requested. The request must be received by the Fire Marshal within 30 days of the permit's date of issuance. In accordance with County practices, all refund requests must be submitted to the Board of County Commissioners for approval. (9) Records The Monroe County Fire Marshal shall keep a permanent and accurate account of all permit fees and other monies collected, the names of all persons upon whose account the same was paid, and the date and amount thereof. (10) Definitions Estimated Value --the cost of all construction. If in the opinion of the Monroe County Fire Marshal or his authorized representative, the value is understated on the application, the permit shall be denied, unless the applicant provided detail cost estimate which meets the approval of the Monroe County Fire Marshal or his authorized representative. 4 (11) Annual Review The fee schedule set forth herein shall be re- viewed annually and if necessary amended to reflect the cost for providing the plan review and inspection processes. Section 2. All Local Laws and ordinances applying to the unincorporated area of Monroe County in conflict with any provi- sions of this ordinance are hereby repealed. Section 3. If any section, paragraph, sentence, clause, phrase, or word of this ordinance is for any reason held by the Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this ordinance. Section 4. The provisions of this ordinance shall become and be made a part of the Code of Laws and Ordinances of Monroe County, Florida. The Sections of the ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. Section 5. This Ordinance shall be effective in those municipal service taxing units established for providing fire protection and those municipalities who contract for such ser- vices pursuant to Laws of Florida, Chapter 83-495. The fee schedule adopted by this Ordinance shall apply as far as possible into the future until such time this Ordinance is amended or repealed. Section 6. The provisions of this ordinance shall become effective upon the acknowledgment of the receipt thereof by the Secretary of State, State of Florida.
