Attached is a proposed change order for Bert Bender for the Old Mariners
Hospital for approval.
According to the ordinance adopted by the Board of County Commissioners,
proposed change orders are to be presented to members of the Board of County
Commissioners prior to approval, assuming they are within the Administrator's
prescribed limits. Change orders not within the Administrator's authority are
placed on the BOCC agenda.
The Administrator intends to approve this change order on Wednesday May 19,
2004.

Detailed description of change order and justification:
1. Fume Hood at Crime Lab: Proposal Request No 10 is for the work related to the fume hood in the
crime lab, This was requested bv the Sheriff to allow proper inyestiQation of crime throuQhout Monroe
Countv. The cost associate with this is and additional $3.472.00,
2. PVC for Copper Water Service: Proposal Request No 12 is a credit to the Owner to substitute PVC
pipinQ in place of soecified copper pjpinq for exterior water service. The substitution is code compliant
and meets the proiect requirements, The pricinq is determined to be fair. The amount of the credit is
<$1,094.00>
3. Windows: Proposal Request No 5 Revised Item No 1 is to depart from the oriqinal contract documents
specification to replace only some of the existinq windows and add new storm shutters to all openinQs.
And, to replace all windows with new impact resistant windows and delete storm shutters, therefore an
exchanQe would minimize the cost impact to Monroe County, This proposal request took a substantial
amount of time to determine the window requirements. therefore the contractor. DL Porter is requestinQ
122 additional davs oertaininQ to this one item. This chanqe order request will increase the contract by
$2.723.60.
4. Concrete Beam: At doors 83 and 85, this unforeseen condition includes lowinq the doors and re-
pourino the concrete header beams, The cost involved in this P.R. will he handled under concrete repair
allowance. Additionally. the contractor is requestinQ (2) additional days added to the contract in
coniunction with this work, which has been included in the total below,
The contractor has requested (124) days extension.

are my recommendation:
Proposal Request No. 10 - Fume Hood at Crime Lab
This Proposal Request was requested by the Sheriff and will allow for proper investigation oj
crimes throughout Monroe County. The cost ofthis work is an add to the contract of$3,47~ .130
and no additional time is requested. We recommend approval based on aU of the following:
1. This work was requested by the Sheriff
2. The fume hood and related additional cabinets are required for the Detective Division to
conduct appropriate investigations of crimes throughout Monroe County.
3. The County receives benefit from this change.
4. I have verified costs and the pricing is fair.
Based on this analysis, I recommend approval of this request as a contract add of$3,472.00.
Proposal request No. 14 - Concrete Band Beam
This Proposal Request is for an unforseen condition that was discovered during roof demoliti :10.
A section of the concrete band beam was discovered to be separating from the ends ofprestn:ss
roof planks and the concrete bond beam supporting the planks. This is a structural condition [hat
requires repair, with costs applied against the contract concrete repair allowance. We recoilllnend
approval based on all of the foJJowing:
1. This was an unforseen condition that could not have been anticipated prior to roof
demolition.
2. This work is a structural repair that is required to maintain the integrity of the roof
3. The contractors request for costs of $2,000 plus OH&P associated with time has beer
rejected in accordance with Monroe County's policy and their construction contract.
4. The contractor's pricing of$1,894.82 without costs for general conditions is fair at a ,mit
price of less than $34/lineal foot.

Based on the above, I recommend accepting Proposal Request No. 14 in the amount of$1,85'4.82
applied against the concrete repair allowance.
Proposal Request No. 12 - PVC for Copper Water Service
This Proposal Request is a credit of$1,094 to the Owner to substitute PVC water service piJ:ing
for the specified copper. We recommend accepting this change order request based on the
following:
1 . The substitution is Code compliant and meets the project requirements.
2_ The pricing has been determined to be fair.
3. The Proposal Request addressed reduced depth of water piping. The piping depth Wi. ,s
reduced due to the fact that the contractor encountered rock. Since no soils report w :~~
available prior to excavation, the rock was determined to be an unforseen condition. r-he
contractor would have required an extra cost change order to meet the specified depti:.
He has not offered a credit for the reduced depth because any savings was offset by tl Ie:
work involved to reach the as built depth of 18 inches.
Based on the above, I recommend accepting the proposed credit of $1 ,094.
Once executed, Proposal Request # 10 and 12 will add a total of $4,566 to the contract and
Proposal Request #14 applied against the concrete repair will reduce it by $1,894.82.

The Sheriff will furnish a fume hood for installation in the Crime Lab, Room No 154. This fume hood will replace
Exhaust Fan No.4, currently exhausting through an existing roof opening in the adjacent Storage, Room No. 155.
Under this proposal request, delete EF-4 with its related 6" duct and electrical hook ups. Provide miscellaneous
materials including any required ductwork and electrical hook ups as may be required for the installation of the fume
hood.
The fume hood will be located on the west wall of Room No. 154, adjacent to the wall between Rooms 154 and 155.
Base cabinets are modified and expanded to accommodate this change.

During field observations on 28 August, 2003, it was noted that the underground water line r :!'lferenced in
18#8 was installed directly adjacent to the west wan of the building_ This wall bears on a ste :'ioed footing
and the water line was placed adjacent to the lower footing, not more than 12" from the faa. ,of the wall.
The depth will be approximately 18 inches below finish grade. A concrete sidewalk will CO\ll~r this area.
providing additional protection_ Lowering this line requires removal of rock substrate.
After discussing these field conditions with Enrique Suarez of HNGS, it is our detenninajon that the
installation is acceptable and complies with the intent of the Specifications. The depths call:d for in the
Specifications anticipated crossing open areas and this installation, adjacent to and paralle I with a wall
footing, provides superior protection. AdditionaJly, plumbing lines along the south side are cIa: 10 enough to
the building and/or under pavement in locations that the 18" depth affords adequate protection.
The installation is approved.

written instructions to order replacement windows on or before Janua:ry 6., 2004. Given the lead
time required to obta.in. these windows" we would anticipate the. very earliest date we would
reeeive initial window shiptnents on site would be about February 15" 2004, Thereafter, even by
fast-tracking the window instS11ation with, the installatiOn ofintcrio-r and exterior finisbe~ it is
easy to see that th,e requested 122 days will be far exceeded.

I am in receipt ofD,L. Porter's pricing for installation of new windows, at Mariners. Followi 19
is my analysis and recommendation:
History:
Proposal Request No.5 was issued on August 26,2003, and revised on August 28,2003. Tb is
Proposal Request consisted of 3 items; #1 dealt with windows and Items #2 and #3 dealt wit!:.
underground utilities, both of which have previously been resolved. Item No, l.a. provided: :,ew
windows, non-impact resistant, and retained the storm shutters shown on the contract dOCUID( :nts.
Item No, l.b. used impact resistant windows and deleted the storm shutters for a credit agairu t
the increased cost of impact resistant windows.
By the September 10, 2003 meeting, we had received pricing with Item l.b., PGT Impact
Resistant Windows, being a no cost change and Item 1.a, standard windows with shutters, ar
approximate add of $25,000. I made a recommendation at that meeting to use the PGT Impa':1
Resistant Windows without shutters at no change in cost to the contract. Monroe County
requested certification of the windows to a higher standard than required by Code or Dade
County protocol, but windows meetings the requested pressures would add in excess of $120 )00
to the project. Since the Codes are based on 3 second gust formulas, a correlation between
windspeeds was required. Specifically, the 2001 Florida Building Code criteria is a 150 mph 3
second gust, but we were asked to calculate window pressures based on 155 mph sustained w illds
which were equated to a 3 second gust of approximately 192 mph.
The delay from September 10,2003 until now was a result of the decision making process an:l
clarification of Monroe County policy as to the standard for wind force resistance of componl ~nts
and cladding, which includes windows, Ultimately, the County clarified their policy to use tl;:
Standards set forth in the Code.

Typically, manufacturers adjust their pricing on an annual basis, and the window manufactur::::r
has notified the contractor ofa price increase for 2004 which adds $2,476.00 to the purchase
price of the windows and $247.60 for contractor overhead and profit for a total of $2,723.60.
Additionally, the contractor has requested a 122 day time extension and related costs of $50Cl per
day for an increase of $61,000 for general conditions, Monroe County's policy allows for a
contract time extension but does not allow for compensation to the contractor for costs relate :I to
delays and extensions of time, as noted in Section 00750, General Conditions of the Contrac1 for
Construction, Article 8.3.
Analysis:
1. The contract documents call for renovation of existing windows with some selected n :lW
windows, and storm shutters over the windows. There was concern among project te: nn
members, including the Owner's representatives from Monroe County, the Sheriff's
Office and the Department of Health, that the old windows were prone to leak:. This i!j a
valid concern and a Proposal Request was issued. The Contractor suggested the use (.f
Code compliant impact resistant windows and deleting the storm shutters as a means )f
offsetting the additional cost of all new windows. This suggestion was accepted and ':::le
Proposal Request was revised two (2) days after its original issue date.
2, The new windows will address the Owner's concerns listed in No. 1 above.
3. The Owner receives benefit from the change to all new windows, at a minimal change: in
cost. These benefits include improved resistance to water infiltration through windo\' 'S,
reduced maintenance and elimination of the labor required to secure shutters during a
storm event.
4. The Contractor has requested a time extension of 122 days based on the time that has
been required to resolve the Proposal Request. I have analyzed the time by reviewing the
Contractors August 29, 2003 Schedule, which shows window restoration and installa1ion
occurring from October 6, 2003 to October 12, 2003. The windows are a critical path
item as interior finishes such as sheet rock, floors and ceilings can not commence unti:
windows are installed. Assuming this Change Order Request will be approved on or
about January 16,2004, and allowing six (6) weeks to deliver windows, a window st8l1:
date can be projected as March 1,2004. Combining the 8/29/03 Schedule time of6 d:tJs
for windows and 9 days for shutters allows 3 weeks for window installation which see:ms
reasonable. Based on this methodology, the time impact is from October 6,2003 to
March 1,2004 or 145 calendar days. ~Iberefore the Request for 122 days appears
justified.

5. For purposes of verifying the above, I have asked the Contractor to provide me with B
schedule analysis of critical path items. After review of that data, I will provide you with
a memo to adjust my time recommendation as needed. This action is taken in the inte r'~st
of expediting the Change Order approval process and consequently the project's
completion.
6. I have verified the Contractor's costs for windows of $2,723,60 as fair and reasonable,
As discussed earlier I have rejected his request for compensation in the amount of
$61,000 for costs related to delays.
Recommendations:
Based on the above, I recommend approval of this Change Order Request in the amount of
$2,723.60 with a contract extension of 122 days.

Dear Don:
Attached is D. L. Porter's pricing for Proposal Request No, 16, concrete beam repairs at Doors 83
and 85. The work includes lowering these doors and re-pouring concrete header beams that had
been removed during a previous remodeling. This is an unforseen condition and would not have
been discovered except that Porter opted to replace these doors and frames under their base bid
contract. The work is required for structural reasons and will be paid under the concrete repair
allowance. Porter's pricing includes a request for 2 days plus general conditions of$500 per day for
a total of$2,168.00 In accordance with Monroe County policy, I have deleted the $1,000 for
General conditions and re-calculated the profit and overhead for a new total of$I,285.00.
I recommend approval of this change order request in the amount of$I,285.00 with two days added
to their contract time. This recommendation is based on the above and with consideration given to
all of the following.
The work is required to repair concrete beams removed by-others during a previous remodeling
project.
This is an unforseen condition that could not have been anticipated,
Since this work will be paid from the concrete repair allowance, the overall scope will not be
impacted by this change order.
The County receives benefit from this change.
Pricing has been determined to be fair and is in accordance, with the construction contract.
