A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZING
THE MAYOR/CHAIRMAN OF THE BOARD TO EXECUTE A REAL
ESTATE SALE CONTRACT AND A DEED OF BARGAIN AND
SALE IN ORDER TO SELL AND CONVEY REAL PROPERTY
OWNED BY THE COUNTY WHICH IS LOCATED IN CUDJOE
GARDENS, 8TH ADDITION.
WHEREAS, Albert A. Waters and John Tkacz were the successful
bidders to buy the real property described hereinbelow, and
WHEREAS, payment in full of the purchase price and of the
required documentary stamps has been received by the County, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Mayor/Chairman of the Board is
hereby authorized to execute a Real Estate Sale Contract and a
Deed of Bargain and Sale, copies of which are attached hereto and
made a part hereof, in order to sell and convey the following
real property:
Lot 12, Block 23 of Cudjoe Gardens 8th Addition, as
recorded in Plat Book 7, Page 16, Monroe County rec-
ords.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 7th day of February, A.D. 1989.

REAL ESTATE SALE CONTRACT
Agreement, made this
day of
1989, between the Board of County Commissioners of Monroe County,
Florida (tfSellertf), and Albert A. Waters and John Tkacz
("Buyers")
At a regular meeting of the Board of County Commissioners on
December 6, 1988, the Seller voted to accept a bid from the
Buyers in the amount of $30,010 to buy the following described
real property:
Lot 12, Block 23 of Cudjoe Gardens 8th Addition, as
recorded in Plat Book 7, Page 16, Monroe County rec-
ords.
In consideration of the foregoing, the parties hereto agree
as follows:
1. The purchase price of $30,010 shall be paid in full by
certified check, which shall be presented to the Seller along
with four properly signed duplicate originals of this contract.
2. The Seller shall convey the property by deed of bargain
and sale, and the Buyers shall pay for the cost of all documen-
tary stamps.
3. The Buyers shall provide their own title insurance, if
desired, and shall have thirty (30) days from the date of this
contract to ascertain that the title is marketable. Objections
to marketability or to survey defects or other matters going to
the marketability of the title shall be waived if not presented
to the Seller in writing within thirty (30) days after the date
of this contract.
4. The date of this contract is defined as the date on
which it is executed by the Seller.
5. The Buyers shall pay all taxes, charges, and other costs
or assessments, whether or not they are recorded, which may be
outstanding against the property.

Florida, GRANTOR,
AND
Albert A. Waters and John Tkacz, as tenants in common, GRANTEES,
of 70 Glen Road, Aston, Pennsylvania 19013,
WITNESSES, that the GRANTOR, for and in consideration of the
sum of
Thirty thousand ten (30,010) dollars
to it in hand paid by the GRANTEES, receipt whereof is hereby
acknowledged, has granted, bargained and sold to the GRANTEES,
their heirs and assigns forever, the following described land
lying and being in Monroe County, Florida:
Lot 12, Block 23 of Cudjoe Gardens 8th Addition, as
recorded in Plat Book 7, Page 16, Monroe County rec-
ords
This instrument is exempt from witnessing and acknowledging
requirements by virtue of F.S. 125.411(2).
IN WITNESS WHEREOF, the GRANTOR has caused these presents to
be executed in its name by its Mayor/Chairman and its Clerk, the
day and year aforesaid.
