BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in
Land Use District Map Boundary Interpretation Number
27 dated
January
3, 1989, attached and incorporated by reference,
is
hereby acknowledged, found to be in
conformance with the
standards set forth in Sec. 9.5-3(m),
Monroe County Code, and
approved.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 21 day of February, A.D., 1989

SUBJECT: Boundary Determination for Lots I, 2, 3, 5, 6 and 7,
Section "A", Long Beach Estates, Big Pine Key
January 3. 1989

Recommended Action: Move the Native (NA)/Improved Subdivision (IS)
boundary from between Lots 7 and 8 to the east property line of Lot 4,
including Lots 5, 6 and 7 in the IS district (Lot 4 is already designat-
ed IS). Leave Lots I, 2, and 3 in the NA District.
Summary of RequestjReport:
The owners of the subject lots have applied for boundary determinations
regarding their properties, which are currently designated NA. Th~
zoning maps in use prior to the adoption of the Land Development Regula-
tions show the lots as General Use (GU). The land immediately west of
the subject site is currently designated IS. The subject lots are locat-
ed in a platted subdi vi sion. Lots 6 and 7. are developed with single
family houses. Lots I, 2, 3 and 5 are vacant. The County Biologist has
inspected the lots and determined that Lot 5 has sufficient upland to
bui Id a single fami ly residence, whereas Lots I, 2 and 3 do not. The
County Biologi st has concluded that Lots I, 2 and 3 have the habitat
necessary to qualify as NA, whereas this designation was assigned to
Lots 5, 6 and 7 in error.
Findings of Fact:
1. The designation of above-mentioned Lots 5, 6 and 7 as IS rather than
NA will be consistent with Section 9.5-213, Purpose of the Improved
Subdivision District, and uses within the district, Section 9.5-242.
2. The designation of above-mentioned Lots I, 2 and 3, as IS rather
than NA would be inconsistent with Section 9.5-213, Purpose of the
Improved Subdivision District, and uses allowed within the district,
Section 9.5-242.
3'. The above determinations were made based on the following:
a. The zoning maps in use prior to the adoption of the Land
Development regulations show the subject lot as GU.
b. The land Use District Maps, signed by Charles Pattison, and
dated February 28, 1986, imprecisely show the NA/IS boundary,
but clearly show Lots 1, 2 and 3 in the NA district.
c. The Land Use District Maps, signed by Donald Craig, and dated
January 19, 1988, show the subject lots as NA.
d. Lots 1, 2, 3 and 5 are vacant.
e. Lots 6 and 7 are developed with single family residences.
f. The land located immediately west of the subject property is
designated IS.
g. Lot 4, which intervenes between Lots 3 and 5, is designated IS.
h. The land immediately to the North and East of the subject proper-
ty is designated NA.
i. All subject lots are located within a platted subdivision.
j. The County Biologist has inspected the subject 10ts and deter-
mined that Lot 5 has sufficient upland to build a single family
residence, whereas Lots 1, 2 and 3 do not.
k. Lots 1, 2 and 3 have the habitat necessary to qualify as Native.
4. Analyses of the existing uses of the properties and surrounding
properties indicate that the essential neighborhood characteristics
support the determination to designate Lots 5, 6 and 7 IS and to
leave Lots 1, 2 and 3 designated NA.
