BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in
Land Use District Map Boundary Interpretation Number 28
dated
January 25, 1989, attached and incorporated by reference, is
hereby acknowledged, found to be in
conformance with the
standards set forth in Sec. 9.5-3(m),
Monroe County Code, and
approved.

Recommended Action: It is recommended that the IndustrialjNative Area
line be redrawn to correspond with the east and south property lines of
the referenced property only. The line can be further modified if need-
ed when additional boundary determination requests are initiated for
other properties.
Summary of RequestjReport:
BACKGROUND
Monroe County proposes to build a combination animal shelter and office
bui Iding on the referenced property on Big Pine Key. The property is
located within two land use districts: Native Area (NA) and Industrial
(I). Due to the conditions of the property, it has been determined that
the proposed building should be allowed as a use as of right in the
Industrial district. However, the building site is currently located
within the NA district (see attached map). Therefore, this boundary
determination request has been initiated on behalf of Monroe County in
order to expedite issuance of a building permit.
RECOMMENDATION
It is recommended that the Industrial/Native Area line be redrawn to
correspond with the east and south property lines of the referenced
property only. The line can be further modified if needed when addition-
al boundary determination requests are initiated for other properties.
SITE DESCRIPTION
The property is fenced and occupied on the north side by a City Electric
diesel generator unit, which is located within the Industrial district.
That area has been filled. The remainder of the property consists of
disturbed wetlands over which fill material has been unevenly scattered
and compacted resulting in irregular low spots with wetland vegetation.
The vegetation consists mainly of sparse clumps of Batis, Salicornia
sp., sea blite, and Distichlis. The only wetland area within the proper-
ty which appears to be relatively undisturbed is the ten foot strip
along the south property line. There is also debris and a travel trail-
er stored on the site. Outside the property line to the south is undis-
turbed salt marsh and buttonwood habitat.
FINDINGS OF FACT
1. The designation of the above-mentioned lot as I rather than NA would
be consistent with Section 9.5-220, Purpose of the Industrial
District, and uses within the district, Section 9.5-249.
2. The above determination was made based on the following:
a. The zoning maps in use prior to the adoption of the Land
Development regulations show the subject property as General
Use (GU).
b. The Land Use District maps, signed by Charles Pattison, and
dated February 28, 1986, imnrecisely show the NAil boundary.
c. The Land Use District Maps, signed by Donald Craig, and dated
January 19, 1988, show the subject lots as NA.
d. The habitat type for this property would be defined as disturbed
with salt marsh and buttonwood for purposes of permitting.
e. Disturbed areas such as these were not intended to fall within
the Native Area district unless special circumstances warranted
such designation.
f. Partial filling of the north side of the property for the gener-
ator unit resulted in further encreachment in the form of irreg-
ular fill and debris over the rest of the property.
g. The undisturbed wetlands start at the south property line (the
habi tat line).
h, The NAil district boundary line should follow the habitat line.
i. The land use in the vicinity of the subject site is industrial
and vacant land.
j. The NA designation was assigned to the property in error.
4. Analysis of the subject property and surrounding properties indi-
cates that the essential neighborhood characteristics suuport the
determination that the land use district boundary be redrawn to
follow the existing habitat line and include the subject property in
the Industrial district.
