RESOLUTION NO. 128 -1989 o ~ A RESOLUTION RESCINDING RESOLUTION NO. 091-1989 AND EXPRESSING SUPPORT FOR CERTAIN AMENDMENTS TO SECTION 236.081, FLORIDA STATUTES, CONCERNING SCHOOL DISTRICT FINANC- ING. WHEREAS, in each year the Legislature appropriates an amount of money to be distributed through the Florida Education Finance Program to each local school district, to offset current operat- ing costs; and WHEREAS, Section 236.081, Florida Statutes, prescribes a formula by which each local school district's share of the funds distributed through this program is determined; and WHEREAS, the formula prescribed in Section 236.081 adversely affects districts where the total value of nonexempt property per student is higher than the statewide average, in that the amount of the contribution from the State is reduced in such districts; and WHEREAS, the School Board of Monroe County has asked the Board of County Commissioners of Monroe County to adopt a resolu- tion expressing their support for certain amendments to Section 236.081, to provide for a certain minimum level of assistance from the State to each district, regardless of the value of property in that district; and WHEREAS, at its regular meeting on February 7, 1989, the Board of County Commissioners of Monroe County passed and adopted Resolution No. 091-1989 in response to the above concerns, and said Board of County Commissioners now desires to rescind said Resolution No. 091-1989, and to adopt a successor resolution which more clearly states the position of said Board of County Commissioners; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: 1. Resolution No. 091-1989, passed and adopted by the Board of County Commissioners of Monroe County at the February 7, 1989, meeting of said Board is hereby rescinded. 2. The Board of County Commissioners expresses its support for an amendment to Subsection 236.081(6), Florida Statutes, to provide that, notwithstanding the amount calculated pursuant to paragraph 236.081(6) (a), the actual amount of the total annual State allocation to any district for current operation shall be at least a certain fixed percentage of the sum of (i) the basic amount for current operation as determined in Subsection 236.081(1), multiplied by the district cost differential factor as determined in Subsection 236.081(2), plus (ii) the amount for the decline in full-time equivalent students as determined in Subsection 236.081(7), before any reduction for the required local effort as determined in Subsection 236.081(4). The Board of County Commissioners recommends that the fixed percentage incorporated in the above change be established at forty percent (40%); however, the Board of County Commissioners recognizes that in determining the appropriate fixed minimum percentage, consid- eration should be given to the ratio of (i) the aggregate required local effort for all school districts collectively, prescribed by the Legislature as an item in the general appro- priations act for each fiscal year, pursuant to Subsection 236.081(4), to (ii) the total allocation of State funds from the Florida Education Finance Program to all districts for operation of schools as determined in the annual appropriations act, in the substantive bill implementing the annual appropriations act, or pursuant to Subsection 236.081(1). 3. The Board of County Commissioners further expresses its support for an amendment to Subparagraph 236.081(1)(f)3, to permit a district for which the wealth adjustment amount cal- culated in that Subparagraph is less than zero, to adopt a resolution reducing any discretionary millage levied pursuant to Section 236.25, to the extent that the decrease in the total amount raised by such discretionary millage is equal to the wealth adjustment factor, in which case no wealth adjustment will be made to the district's allocation of sparsity supplement funds. 2 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of said Board held on the -f.JL day of //Ja ,.d .
