BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in
Land Use District Map Boundary Interpretation Number 35
dated
April
21, 1989, attached and incorporated by reference,
is
hereby acknowledged, found to be in
conformance with the
standards set forth in Sec. 9.5-3(m),
Monroe County Code, and
approved:

Previous Relevant Board Action: 8/:27/87 (#53)
The Board voted to accept the recommendation of the Planning Commission
to approve Amendment #53 Joie Salus, NA to IS.
Recommended Action: Move the NA/lS boundary to include the two above
described lots in the IS District.
Findings of Fact:
1. The designation of the above property as Improved Subdivision (IS)
rather than Native Area (NA) will be consistent with Section 9.5-213,
Purpose of the Improved Subdi vi s ion Di stricts and uses allowed wi thin
the district, Section 9.5-242.
2. The determination was made baj;,'!d on the following:
The boundary between the NA and IS district is imprecise on the
maps signed by Charles Pattison and effective 9/15/86.
The zoning maps in use before the Land Use Plan show these
lots as General Use (GU).
There is a single family residence on one lot (RE# 113150),
and there is a single family residence on either side of Mr.
Joie Salus' lot (RE# 113210).
There is sufficient uplar,ds for a single family residence on
both lots.

INTRODUCTION:
The Monroe County Planning Department has requested a boundary
determination on the referenced lots. The lots are presently
located within the Native Area (NA) land use district. The appli-
cant feels that the lots should be changed to Improved Subdi vi-
sion (IS) so that a single family residence can be built.
SITE DESCRIPTION:
Lot RE# 113210 is a vacant lot with native upland tree species.
The lot is bounded on the west by Pine Channel. There are a few
mature Red mangroves and seedlings within the boundaries of the
lot (survey stakes are set) and a Red Mangrove fringe exists
directly west of the survey stake and continues to the Channel.
There is an existing single family residence on lot RE#113l50 to
the south, and another on lot RE#113l60 to the north. Al though
nati ve species are dominant, exotic vegetation has begun to in-
vade and there are two abandoned cars and a large pile of plant
debris on the lot.
EVALUATION:
Lot RE#1132l0 appears to more closely meet the criteria for the
IS land use district, as does lot RE# 113150. There appears to
be sufficient uplands for a single family residence.
RECOMMENDATION:
It is recomended that the IS boundary be extended to include both
lots RE# 113210 and RE# 113150.
