I- L: c:I: ( L l- I C L_~ = ~ C -, W -.l ~ u- RESOLUTION NO. 279 -1989 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, ACCEPTING A GRANT FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL 'R~GULATION UNDER THE USED OIL RECYCLING GRANT ,PRQGRAM AND AUTHOR I ZING THE MAYOR TO EXECUTE A CONTRACT IN FURTHERANCE THEREOF. WHEREAS, by Resolution 054-1989, the Board of County Commissioners of Monroe County, Florida, authorized the submission of a grant application to the Florida Department of Environmental Regulation under the Used Oil Recycling Grant program, and WHEREAS, the Florida Department of Environmental Regulation has awarded Monroe County a grant in the amount of $25,000 for improvements to used oil collection centers at the Cudjoe Key, Long Key, and Key Largo landfills, and the Marathon Public Works facility, and WHEREAS, the Florida department of Environmental Regulation has issued Contract U 58 as part of the grant award, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the said grant is hereby accepted and the Mayor is authorized to execute the said contract. Recycling grants shall be used to provide funding for public'awareness/promotion campaigns to encourage the collection and proper management for used oil; recycling program capital costs, which include equipment purchase and facility construction; and other such costs approved by the Department as part of the proposed budget. 2. Quarterly reporting is required to the Department of Environmental Regulation on the sta~us of the used oil recycling pro]ectincluding a list of ~-rent and cumu~ative expenditures, additional local governmen~ expenditures if applicable, unexpended balances, and accrued interest. Reports are due by the end of a thirty day period following each 90 day period after agreement execution. 3. The interest accrued on advanced grant fUnds placed in an ,interest-bearing account shall be tracked separately and be applied against 'the next reimbursement or be returned to the Department of Environmental Regulation's Solid Waste Management Trust Fund as soon as Grant F1Inds are exhausted. Any unexpended award amount, will revert back to the Department at the end of the gran~ period. 5. Grantees shall obtain all necessary construction- related permits before initiating construction. I 6. . Expenditure reports and payment requests must be accompanied by supporting invoices' and documents. 7. Each recipient of grant funds shall maintain accurate records of all expenditures of grant funds and shall assure that these records are available at all reasonable times for inspection, review, or audit by Department personnel and other personnel authori~ed by the Department. Records shall be kept for a period of three (3) years following the end of the grant period. B. SPECIAL CONDITIONS 1. Allowable costs incurred after June 1, 1988 may be charged to this agreement in accordance with 17-720.300(3), F.A.C. 2. A public used oil collection center funded by this grant must be operational within one year of execution of this agreement. 3. Local governments receiving these grant funds must accept used oil from households at the used oil collection center for at least two years after the facility is operational. 4. Acceptance of this grant obligates the local government ~to comply with the requirements of Chapte:::- 17-720, Florida Administrative Code, concerning the Used Oil Recycling Grant Program, as well as applicable Florida Statutes and rules. 5.
