A RESOLUTION OBJECTING TO LINKING MONROE
COUNTY'S DEVELOPMENT TO THE STATE'S INABILITY
TO IMPROVE AND MAINTAIN U. S. HIGHWAY 111;
SEEKING REINSTATEMENT OF COUNTY PROJECTS
REMOVED FROM DEPARTMENT OF TRANSPORTATION'S
5-YEAR PLAN; REQUESTING STATE FUNDING FOR THE
LOCAL ROAD SYSTEM AS IT AFFECTS THE LOCAL
TRANSPORTATION LEVEL OF SERVICE; SEEKING
INDEPENDENCE AND FLEXIBILITY FOR LOCAL
GOVERNMENT IN CREATING, ESTABLISHING AND
MAINTAINING A COUNTY ROAD SYSTEM.
WHEREAS, the State Legislature has been called into special
session November 1989 to address transportation issues, and
WHEREAS, the State has linked the County's use of its land
to the State's inability to maintain and improve U. S. Highway 11
to capacity, and
WHEREAS, the County is threatened with a moratorium because
the County's ability to maintain and improve the only road
running through the County is beyond the County's financial
capabilities, and
WHEREAS, the State has removed several U. S. Highway 111
projects from the Department of Transportation's 5-Year Plan, and
WHEREAS, the State has not funded for concurrency when it
affects the local transportation level of service, and
WHEREAS, Florida Statute 511.076 provides that where a
general law serves both state and local objectives, a means to
finance such activity, services or facility may be provided by
the Legislature, and
WHEREAS, the County wants independence and flexibility in
maintaining a County road system without State interference, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. The Board obj ects to the linking of Monroe County's
development to the State's inability to improve and maintain
U. S. Highway HI under Florida Statute i335.04(1)(b) and
338.01(1) and (2).
2. The Board seeks reinstatement of the County proj ects
removed from the Department of Transportation's 5-Year Plan.
3. The Board requests State funding for the local road
system as it affects the local transportation level of service
under Florida Statute ~11.076.
4. The Board seeks independence and flexibility for local
government in creating, establishing and maintaining a County
road system.
5. The Clerk of the Board is hereby directed to forward a
certified copy of this resolution to the Florida Department of
Transportation and our Legislative delegation.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
