A RESOLUTIO~jI)M~rir .fR~Nkb~~' OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, REQUESTING THE MONROE COUNTY
LEGISLATIVE DELEGATION TO DRAFT AND SPONSOR THE
NECESSARY LEGISLATION TO IMPLEMENT THE PROVISIONS OF
SECTION 18 OF ARTICLE VII OF THE FLORIDA CONSTITUTION.
WHEREAS, the Legislature of the State of Florida enacted
Florida Statute section 11.076 in 1978, which statute required
any general law enacted by the Legislature after 1978 which
required a county to perform an activity or render a service
which required an expenditure of additional funds that such Bill
be accompanied with an economic impact statement estimating the
amount sufficient to cover the cost to the county and identifying
the means to finance such activity, and
WHEREAS, the purpose of such statute was to require the
Legislature to provide funding sources for mandates, and
WHEREAS, despite the existence of this statute since 1978,
it has been honored more in the breach than in the observance,
and
WHEREAS, the Constitution of the State of Florida was
amended in 1990 to provide for Section 18 of Article VII, which
Constitutional amendment provides that no county shall be bound
by any general law which requires the county to spend funds or
take an action requiring the expenditure of funds unless the
funding source has been identified and funds appropriated saving
certain extraordinary circumstances, and
WHEREAS, the aforementioned amendment to the Florida
Constitution provided that the Legislature may enact laws to
assist in the implementation and enforcement of Section 18 of
Article VII; however, the Legislature has failed to enact any
such laws and the Legislature continues to issue unfunded
mandates to the several counties to the detriment of the voters
and the taxpayers in those areas, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
1. The Legislative Delegation of Monroe County sponsor
necessary legislation to implement the provisions of Section 18
of Article VII of the Florida Constitution so that financing
sources and appropriations become a necessary part of any state
mandate by way of legislation which would require the expenditure
of any funds by the several counties.
2. The Clerk is hereby directed to forward a certified
copy of this resolution to the members of the Monroe County
Legislative Delegation.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regularly scheduled meeting held on
the 16th day of February , 1994.
