A RESOLUTION ANNOUNCING THE INTENT OF THE
BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY TO UTILIZE THE UNIFORM METHOD OF LEVY,
COLLECTION, AND ENFORCEMENT OF NON-AD VALOREM
AasESSMENTS AS AUTHORIZED IN SEC. 197.3632,
F~. STAT., FOR THE COLLECTION OF NON-AD
c V~OREM SPECIAL ASSESSMENTS ON RESIDENTIAL
REAL PROPERTY IN MONROE COUNTY EXCLUDING THE
CITY OF KEY WEST BUT INCLUDING THE
MUNICIPALITIES OF LAYTON AND KEY COLONY BEACH
FOR THE PURPOSE OF PROVIDING SOLID WASTE
DISPOSAL SERVICES AND CAPITAL FACILITIES.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
There is currently a need to collect in an
administratively expeditious and economical fashion non-ad
valorem assessments on residential real property for the purpose
of providing funding to the County's Municipal Service District
for the provision of solid waste disposal services and capital
facilities in Monroe County.
Section 2.
Therefore, the Board of County Commissioners,
as the governing body of Monroe County and the Municipal Service
District, hereby announce their intention in fiscal year
1990-1991 to use the uniform method for the levy, collection and
enforcement of non-ad valorem assessments, as authorized in Sec.
197 .3632, Fla. Stat. (1988 Supp.), for the levy, collection and
enforcement of such assessments on residential real property
located in Monroe County excluding the City of Key West and that
part of the County located on the Florida mainland but including
the municipalities of Layton and Key Colony Beach. The
non-ad valorem assessments were formerly termed special
assessments and collected directly by the Municipal Services
District.
Section 3.
The use of the uniform method for the levy
collection and enforcement of non-ad valorem assessments will
mean that such assessments shall be subject to all provisions of
Chapter 197, Fla. Stat., including provisions relating to dis-
count for early payment, prepayment by installment method,
deferred payment, penalty for delinquent payment, and issuance
and sale of tax certificates and tax deeds for nonpayment.
Section 4.
Upon approval, a certified copy of this
resolution shall be sent to the Property Appraiser and Tax
Collector and the Department of Revenue by U.S. mail.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
