RESOLUTION NO. 763 -1989
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZ-
ING THE MAYOR/CHAIRMAN OF THE BOARD TO
EXECUTE AN AGREEMENT BETWEEN THE BOARD AND
THE MENTAL HEALTH CARE CENTER OF THE LOWER
KEYS, INC. CONCERNING FUNDING FOR FY89-90.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Mayor/Chairman of the Board is
hereby authorized to execute an Agreement between the Board and
the Mental Health Care Center of the Lower Keys, Inc., a copy of
same being attached hereto and made a part hereof, concerning
funding for FY89-90.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 13th day of

A G R E E MEN T
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, and the Mental Health Care Center of the Lower Keys,
Inc., desire to enter into an agreement wherein the Board of
Countv Commissioners contracts for services from said Center for
.
the rendering of mental health services to the citizens of the
Lower Keys, Monroe County, Florida, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida is vested and charged with certain duties and
responsibilities relating to the mental health and guidance of
the citizens of Monroe County, and
WHEREAS, such services have been invaluable to the citizens
of the Lower Keys, Monroe County, Florida, and
~IEREAS, it is proper and fitting to enter into an agreement
for services to be rendered in the forthcoming fiscal year
1989-90; now, therefore,
THIS AGREEMENT made between the Board of County Commis-
sioners of Monroe County and the Mental Health Care Center of the
Lower Keys, Inc. each in the consideration of the premises, agree
as follows:
The said Board of County Commissioners of Monroe County,
Florida, in consideration of said Mental Health Care Center of
the Lower Keys, Inc. substantially and satisfactorily performing
and carrying out the duties and obligations of the Board as to
rendering counsel to the citizens of the Lower Keys, Monroe
County, Florida, in matters of mental health and guidance, drug
rehabilitation and providing transportation to treatment
facilities as required by Florida Statute 394.459 for Monroe
County patients, agrees to:
1. Pay to the said Mental Health Care Center of the Lower
Keys, Inc. the sum of Seventy-six Thousand Eight Hundred Eight
Dollars ($76,808.00) for rendering counseling services.
2. Pay an additional sum not to exceed Eighty Thousand
Dollars ($80,000.00) for the providing of drug rehablitation
services.
3. Pay an additional sum not to exceed Forty-five Thousand
Six Hundred Seventy-three Dollars ($45,673.00) for the providing
of transportation of patients in Monroe County to treatment
facilities (Baker Act Transportation), and
4. Pay an additional sum not to exceed Sixteen Thousand
Five Hundred Twenty-eight Dollars ($16,528.00) for the T.A.S.C.
Program. (Treatment Alternative for Street Crimes).
These figures will be paid monthly commencing October 1,
1989 and ending September 30, 1990, as hereinafter set forth.
And the said Mental Health Care Center of the Lower Keys,
Inc. for the consideration named, covenants and agrees with the
Board of County Commissioners of Monroe County, Florida, to
substantially and satisfactorily perform and carry out the duties
of the said Board in rendering counsel in the matters of mental
health and guidance to the citizens of the Lower Keys, Monroe
County, Florida, and transporting patients in Monroe County to
treatment facilities in accordance with Florida Statute 394.459.
In further consideration of said financial remuneration, the
said Mental Health Care Center of the Lower Keys, Inc. agrees to
provide a clear financial audit trail to allow for full
accountability of funds received from said Board. Certified
monthly financial and service load reports will be made available
to the Board of County Commissioners of Monroe County, Florida,
to validate the delivery of services under this contract. The
monthly financial report is due in the office of the Clerk of the
Board of County Commissioners of Monroe County, Florida, no later
than the 15th day of the following month. After the Clerk of the
Board pre-audits the certified report, the Board will reimburse
said Mental Health Care Center of the Lower Keys, Inc. for its
monthly expenses. However, the total of said monthly payments in
the aggregate sum shall not exceed the total amount of $76,808.00
for counseling, $80,000.00 for drug rehabilitation services,
$45,673.00 for baker act transportation cost and $16,528.00 for
the T.A.S.C. program durine the term of this contract.
5. The Mental Health Care Center of the Lower Keys, Inc.
shall indemnify Monroe County for all claims of any sort that
arise from the use of this funding. In this respect, the Mental
Health Care Center of the Lower Keys, Inc. shall hold Monroe
County harmless and assume all responsibility for any claims or
damages resulting from the use of this funding during the time
wherein the funding continues.
