RESOLUTION NO. 018 -1986
RESOLUTION UPHOLDING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
WITHOUT PREJUDICE, AND DENYING THE REQUEST OF
R.D. FRYE TO REVERSE THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA,
DENYING HIS REQUEST FOR A CHANGE OF ZONING
FROM RU-1 TO BU-IL ON PROPERTY LOCATED ON KEY
VACA, FLORIDA.
WHEREAS, on July 31, 1985, the Zoning Board of Monroe
County, Florida, denied a reques t for a change of zoning from
RU-l to BU-IL on the following described property:
Parcel A-I, situated in a part of Government Lot 4,
Section 1, Township 66 South, Range 32 East, Key Vaca,
Monroe County, Florida, and known as being part of
those lands conveyed to R.D. Frye by deed recorded in
Official Record Book 727 at Page 146 of the Monroe
County deed records and being more particularly
described by metes and bounds. Located on U. S. 1 &
95th Street.
WHEREAS, R. D. Frye has duly appealed said decision to the
Board of County Commissioners of Monroe County, Florida, sitting
as the Board of Appeals, and the Board having reviewed the
transcript of the July 31, 1985 hearing, having considered the
argument of all parties present wishing to speak on the matter,
and all premises considered, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the July 31, 1985, decision of the Zoning Board of
Monroe County, Florida, denying a change of zoning from RU-l to
BU-IL be, and the same is hereby upheld.
2. That said R. D. Frye be, and he is hereby denied a
reversal of the decision of the Zoning Board of Monroe County,
Florida, denying his request for a change of zoning from RU-l to
BU-lL on the above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 15th day of January
A.D. 1986.
