Resolution 131-1986 RESOLUTION NO. 131-1986 A RESOLUTION DESIGNATING MONROE COUNTY CODE ENFORCEMENT OFFICERS OR THEIR DESIGNEES TO REMOVE ABANDONED PROPERTY FROM ITS LOCATION ON PUBLIC OR PRIVATE PROPERTY. WHEREAS, Florida Statute 705.16 provides that a enforcement officer, upon ascertaining that an article of abandoned property is present on public or private property, shall take the necessary procedures to have said abandoned property removed and destroyed, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, has determined that abandoned property should be removed from public or private property, and WHEREAS, the Board of County Commissioners of Monroe County, Florida has determined that the Code Enforcement officers or their designees are best qualified to take the necessary procedures, pursuant to Florida Statute 705.16, to have abandoned property removed, now, therefore BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows: 1. That the Code Enforcement Officers for Monroe County, Florida, or their designees shall be authorized, pursuant to Florida Statute 705.16, to have abandoned property removed and destroyed. 2. A notice shall be attached to the abandoned property giving notice to the owner and all persons interested in the attached property that the property is unlawfully upon public property and must be removed within 10 days. If the property is a boat, then the same must be removed within 30 days from date of notice. If not removed within the prescribed time J then the property will be presumed abandoned and subsequently removed and destroyed. 3. If the abandoned property is on private property J a notice shall be attached to the abandoned property. The notice shall inform the owner and all interested persons that the same is unlawfully situated on private property and must be removed wi thin ten (10) days, or if a boat then thirty (30) days from date of notice. If not removed within the prescribed time, then the property will be presumed abandoned and subsequently removed and des troyed. In addition, the Code Enforcement Officers or their designees shall mail a copy of the notice to the owner of the real property upon which the abandoned property is located. If the abandoned property is a car or boat, then a reasonable effort should be made to ascertain ownership.
