RESOLUTION NO. 245-1986
RESOLUTION UPHOLDING THE DECISION OF THE
ZONING BOARD OF MONROE COUNTY, FLORIDA, UPON
RECONSIDERATION, AND DENYING THE REQUEST OF
503851 ONTARIO LIMITED TO REVERSE UPON
RECONSIDERATION THE DECISION OF THE ZONING
BOARD OF MONROE COUNTY, FLORIDA WHICH DENIED
A FINDING OF FACT APPROVAL TO ONTARIO
LIMITED.
WHEREAS, on February 19, 1986, the Board of County Commis-
sioners of Monroe County, Florida, sitting as the Board of
Adjustment, denied a reversal of the decision of the Zoning Board
of Monroe County, Florida, denying Ontario Limited's request for
a finding of fact approval to build within the shoreline pro-
tection zone on the following described property:
Parcel I: A parcel of submerged land in Section 29,
Township 64S, Range 36E, Monroe County, Florida, and
more particularly described by metes and bounds.
Parcel II: A parcel of submerged land in Section 29 &
30, Township 64S, Range 36E, Monroe County, Florida,
more particularly described by metes and bounds,
Parcel III: A spoil island in the Florida Bay in the
Northwesterly % of Section 29, Township 64S, Range 36E,
Monroe County, Florida, more particularly described by
metes and bounds, located at Mile Marker 73.5, U.S. #1,
Lower Matecumbe, Zoned GU.
WHEREAS, Ontario Limited has duly requested a reconsid-
eration of said decision by the Board of Appeals, and the Board
having granted such reconsideration, and the Board having
re-reviewed the transcript of the November 6, 1985 hearing, and
having re-considered the argument of all parties wishing to speak
on the matter, and all premises considered, now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, sitting as the BOARD OF APPEALS, as
follows:
1. That the November 6, 1985, decision of the Zoning Board
of Monroe County, Florida, denying a finding of fact approval to
build within the shoreline protection zone be, and the same is
hereby upheld for lack of error by the Zoning Board.
2. That said 503851 Ontario Limited be, and it is hereby
denied a reversal of the decision of the Zoning Board of Monroe
County, Florida, denying its request for a finding of fact
approval to build within the shoreline protection zone on the
above-described property.
3. That the Clerk is hereby directed to make available to
the Field Representative of the Department of Community Affairs a
certified copy of this resolution by certified mail to said Field
Representative, Post Office Box 990, Key West, Florida 33041,
return receipt requested.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, sitting as the Board of Appeals, at a
regular meeting of said Board held on the 20th day of August,
A.D. 1986.
