RESOLUTION NO. 258-1986
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA,
AUTHOR I ZING THE MAYOR AND CHAIRMAN OF THE
BOARD TO EXECUTE AN INTERLOCAL AGREEMENT BY
AND BETWEEN THE COUNTY OF MONROE AND THE CITY
OF LAYTON, CONCERNING THE OPTIONAL SIX CENT
GAS TAX.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
That the Mayor and Chairman of the Board of County Commis-
sioners of Monroe County, Florida, is hereby authorized to
execute an Interlocal Agreement by and between the County of
Monroe and the City of Layton, a copy of same being attached
hereto, concerning the optional six cent gas tax,
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 22nd day of August, A.D. 1986.

INTERLOCAL AGREEMENT
WHEREAS, Ordinance No.
-1986 establishes a formula for
the distribution between the incorporated municipalities of the
six cent local option gas tax; and
WHEREAS, it is desired to extend the previously agreed upon
formula to the distribution of the newly extended six cent option
gas tax (previously enacted as the four cent option gas tax in
Ordinance No.014-1983 and the fifth and sixth cent option gas tax
in Ordinance No. 028-1985); and
WHEREAS, so as to comply with the requirements of State law
and to continue said tax as provided herein;
NOW, THEREFORE, pursuant to the authority granted in F.S.
163.01 and F.S. 336.025, it is hereby mutually agreed between the
County of Monroe and the City of
Layton
that
'the percentage distribution of all portions of the optional six
cent gas tax shall be as follows:

Nothing in this inter local agreement shall be construed to
require the County of Monroe to extend the first four cents of
the tax beyond three years or to extend the fifth and sixth cents
of the tax beyond one year.
This inter local agreement shall take effect when an executed
copy is filed with the Clerk of the Circuit Court, Monroe County,
Florida.
