RESOLUTION NO. 265-1986
A RESOLUTION FINDING THAT A PROPOSED CHANGE
TO A PREVIOUSLY APPROVED DEVELOPMENT OF
REGIONAL IMPACT KNOWN AS PORT BOUGAINVILLE
AND GARDEN COVE IS NOT A SUBSTANTIAL DEVIA-
TION AND DENYING THE PROPOSED CHANGE.
WHEREAS, in an application dated June 16, 1986, Wade
Hopping, Receiver, and authorized representative for Port
Bougainville Associates, Ltd., a Florida limited partnership,

General Partner,
Port Bougainville
Enterprise, Inc., a Florida corporation, Fritz E. Sharenberg,
President, and Garden Cove, Inc., a Florida corporation, Fritz E.
Sharenberg, President, applied for an approval of a proposed
change to a previously approved development order for a
development of regional impact, and
WHEREAS, the proposed change would have amended Monroe
County Resolution No. 277-1982, Section 54, by extending for four
(4) additional years the amount of time in which the applicant
had to complete certain improvements to the project site in order
to prevent the development order from becoming "null and void",
according to paragraph 54 of the Development Order, and
WHEREAS, a public hearing was held by the Board of County
Commissioners of Monroe County, Florida, on the application,
after proper notice, at 5:00 p.m. on August 22, 1986, and
WHEREAS, the Board of County Commissioners of Monroe County,
Florida, at the public hearing duly considered the evidence and
argument of the applicant, county staff, the Florida Department
of Community Affairs and concerned members of the public, now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Pursuant to Florida Statute 380.06(19) (f) (5) and (6), the
applicant's proposed change to a previously approved development
of regional impact is:
a.) Found not to be a substantial deviation; and
b.) Denied.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 22nd day of August, A.D. 1986.

MONROE COUNTY BOARD OF COUNTY COMMISSIONERS
MONROE COUNTY, FLORIDA
NOTICE IS HEREBY GIVEN, that the Monroe County Board of
County Commissioners will hold a public hearing on August 8, 1986
in Courtroom "B" of the Courthouse Annex Building located at,500
Whitehead Street, Key West, Monroe County, Florida, beginning at
8: 30 a.m. to consider issuance of an Amended Development of
Regional Impact ("DRI") Development Order amending the DRI
Development Orders issued as Resolution Nos. 277-1982 and
272-1984 for the Developments of Regional Impact known as Port
Bougainville and Garden Cove.
Such change would extend the
build-out period of the project for four (4) additional years.

of Regional Impact constitute a substantial deviation pursuant to
Section 380.06 (19), Florida Statutes.
The petition requesting
changes to these previously approved DRIs and a substantial
deviation determination were filed by Wade Hopping as Receiver
for Port Bougainville and Garden Cove.
Pursuant to the authority of Florida Statute 380.06(9) (f)
and (g), at the above-described hearing the Commission may
approve the proposed change and issue the amended development
order, approve and issue an amended development order with
additional conditions, deny the proposed change, or order that
the proposed change undergo further development of regional
impact review.
Information regarding the aforesaid requests may be reviewed
at: the Plantation Key Governmental Center, Plantation Key,
Florida 33070; Marathon Sub-Courthouse, Marathon, Monroe County,
Florida; and the Monroe County Building and Zoning Department,
Wing Two, Public Service Building, Stock Island, Key West,
Florida 33040.
Further, pursuant to Section 286.0105, Florida Statutes,
notice is given that if a person decides to appeal any decision
made by the Board with respect to any matter considered at such
hearing or meeting, he will need a record of the proceedings, and
that, for such purpose, he may need to ensure that a verbatim
record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based.
