Resolution 265-1986 Monroe County Commission RESOLUTION NO. 265-1986 A RESOLUTION FINDING THAT A PROPOSED CHANGE TO A PREVIOUSLY APPROVED DEVELOPMENT OF REGIONAL IMPACT KNOWN AS PORT BOUGAINVILLE AND GARDEN COVE IS NOT A SUBSTANTIAL DEVIA- TION AND DENYING THE PROPOSED CHANGE. WHEREAS, in an application dated June 16, 1986, Wade Hopping, Receiver, and authorized representative for Port Bougainville Associates, Ltd., a Florida limited partnership, Fritz E. Sharenberg, General Partner, Port Bougainville Enterprise, Inc., a Florida corporation, Fritz E. Sharenberg, President, and Garden Cove, Inc., a Florida corporation, Fritz E. Sharenberg, President, applied for an approval of a proposed change to a previously approved development order for a development of regional impact, and WHEREAS, the proposed change would have amended Monroe County Resolution No. 277-1982, Section 54, by extending for four (4) additional years the amount of time in which the applicant had to complete certain improvements to the project site in order to prevent the development order from becoming "null and void", according to paragraph 54 of the Development Order, and WHEREAS, a public hearing was held by the Board of County Commissioners of Monroe County, Florida, on the application, after proper notice, at 5:00 p.m. on August 22, 1986, and WHEREAS, the Board of County Commissioners of Monroe County, Florida, at the public hearing duly considered the evidence and argument of the applicant, county staff, the Florida Department of Community Affairs and concerned members of the public, now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Pursuant to Florida Statute 380.06(19) (f) (5) and (6), the applicant's proposed change to a previously approved development of regional impact is: a.) Pursuant to the authority of Florida Statute 380.06(9) (f) and (g), at the above-described hearing the Commission may approve the proposed change and issue the amended development order, approve and issue an amended development order with additional conditions, deny the proposed change, or order that the proposed change undergo further development of regional impact review.
