THE TROPICAL FLYWAYS SITE ON KEY LARGO
KNOWN AS "CURRY COVE" AND CONCERNING THE
APPEAL OF MONROE COUNTY CIRCUIT COURT CASE
NO. 92-503-CA-18.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA that the Board desires to communicate to
the Governor and Cabinet, State of Florida, its position on the
proposed acquisition, through the CARL program, of the 71-acre
tract of hardwood hammock, part of the "Tropical Flyway" acquisi-
tion and situated on Key Largo, and known as the major develop-
ment "Curry Cove."
The Board supports the acquisition on the following condi-
tions:
(1) The Sellers must dismiss their pending federal action
for damages against Monroe County alleging that Monroe
County deprived them of rights to develop "Curry Cove";
(2) The Sellers must enter into a mutual release with Monroe
County and the State of Florida releasing the County and
the State from any unasserted claims the sellers may
have arising from the "Curry Cove" major development; and
(3) The Sellers must join with Monroe County and the State
of Florida in a Motion to Vacate the Circuit Court Final
Judgement in Case No, 92-503-CA-18.
Upon acquisition of Curry Cove by the State of Florida, and
satisfaction of the above-stated conditions, the Board shall
direct its attorneys to dismiss the pending appeal of Monroe
County Circuit Court case no. 92-503-CA-18.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 18th day of
