Item L5 BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: June 16, 2004 Division: Growth Management Bulk Item: Yes No X Department: N/A AGENDA ITEM WORDING: A resolution of the Monroe County Board of County Commissioners authorizing submission of a Florida Forever Boundary Modification form and designation of Monroe County as Land Manager therein for the conservation lands. ITEM BACKGROUND: In response to County requests, the Florida Department of Environmental Protection has agreed to make all vacant, privately-owned properties within the County's designated Conservation and Natural Areas (CNA) as candidates for inclusion in the Florida Forever via boundary modification. The State is currently sending out letters to property owners in Phase One of this boundary modification. In order to receive benefit of State acquisition funding under the Florida Forever Program, each boundary modification form submitted must identify a property manager, as the State or Federal government may not be willing to manage the property. The County's Land Steward will be the designated property manager for those conservation properties. Land Management activities will be financed from the County's Environmental Land Management and Restoration Fund. The dedicated source of funding for this Fund will be from the mitigation fees paid by property owners when native habitat is cleared. Although the staff is still working on estimates of potential costs to the County to manage these conservation lands, the staff believes the mitigation fees coupled with the State grants for invasive plant removal should be sufficient to enable the County to carry out is responsibilities. The Growth Management Division staff will be preparing a master land acquisition and management plan during the next six months, which will more fully detail the anticipated costs for land management, including appropriate land management responsibilities of the County and various State, Federal, and non-governmental organizations throughout the CNA. As part of this plan, the County staff will identify appropriate County staffing, procedures and organizational changes to carry out these land management responsibilities in an efficient and effective manner. The County staff is currently preparing detailed maps and a list of candidate properties for inclusion within the Florida Forever boundary expansion, This information will be available shortly and will be included in the boundary modification application(s). Growth Management RESOLUTION NO. 2004 A RESOLUTION OF THE MONROE COUNTY BOARD OF COMMISSIONERS AUTHORIZING SUBMISSION OF A FLORIDA FOREVER BOUNDARY MODIFICATION FORM AND DESIGNATION OF MONROE COUNTY AS LAND MANAGER THEREIN FOR CONSERVATION AND NATURAL AREA LANDS. WHEREAS, on August 20~ 2003, the Monroe County Board of County Commissioners adopted Resolution 346-2003, thereby identifying natural areas appropriate for public acquisition on the Conservation and Natural Areas (CNA) Map; and WHEREAS, State funding is available through the Florida Forever program to acquire natural areas in the Keys where such lands are included within a designated Florida Forever project; and WHEREAS, due to the Area of Critical State Concern designation, Outstanding Florida Waters designation, high biodiversity, and potential impacts on State-owned conservation lands, all properties in the CNA are candidates to be added to a Florida Forever project via a boundary modification; and WHEREAS, in order to receive the benefit of State acquisition funding, all boundary modification forms must identify a property manager; and WHEREAS, the state and federal governments already manage the majority of the publicly owned properties within the CNA; and WHEREAS, there may be some properties in the CNA which the land managing agencies at the state and federal levels are either unable or unwilling to manage and for which Monroe County will be the only available manager; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS, MONROE COUNTY, FLORIDA THAT: SectiOD 1. Staff is hereby authorized to submit a Florida Forever boundary modification fonn to the Florida Department of Environmental Protection for the balance of the vacant, private property within the CNA which is not already included within the existing Florida Forever projects or their proposed additions. Where there is no willing manager available at the state or federal government level, staff is authorized to identify Monroe County as the designated land manager on the boundary modification fonn.
