RESOLUTION NO.
346 -1987
A RESOLUTION PROVIDING STANDARDS FOR THE
BUILDING OFFICIAL TO UTILIZE IN INTERPRETING
AND ADMINISTERING CERTAIN PORTIONS OF SECTION
6-105, MONROE COUNTY LAND DEVELOPMENT REGU-
LATIONS.
WHEREAS, certain portions of Section 6-105, Monroe County
Land Development Regulations, pertaining to the expiration of
building permits, give wide latitude to the Building Official to
decide when various conditions precedent to expiration occur; and
WHEREAS, such latitude can sometimes lead to the arbitrary
treatment of similarly situated permit holders; and
WHEREAS, it is desired to avoid any such injustices and
provide guidance for the Building Official; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section 1.
In determining whether work has been "sus-
pended or abandoned" for the 120 or 60 consecutive day period of
Sections 6-105(A) and (B), Monroe County Land Development Regu-
lations, it is the policy direction of the Board of County
Commissioners that the Building Official shall consider only the
following:
During the course of the 120 or 60 day period has a
structural inspection been called for and, when conducted,
has the work inspected been approved? If yes, then the work
shall not be considered suspended or abandoned for the
purpose of Section 6-l05(A) and (B), Monroe County Land
Development Regulations. If no structural work has passed
an inspection during the 120 or 60 day period, then a
suspension or abandonment shall be considered to have
occurred for the purposes of Section 6-l05(A) and (B),
Monroe County Land Development Regulations.
Section 2.
In determining whether the holder of a
building permit is satisfying the conditions of the first sen-
tence of Section 6-105 (F) and all of Section 6-105 (C), Monroe
County Land Development Regulations, it shall only be necessary
to consider whether the work has been suspended or abandoned
under the terms set forth in Section One of this Resolution. If
the work has not been suspended or abandoned under the terms of
Section One of this Resolution, then the requirements of the
first sentence of Section 6-105(F) and all of Section 6-105(C),
Monroe County Land Development Regulations, are satisfied. If
the work has been suspended or abandoned according to the terms
of Section One of this Resolution, then the requirements of the
first sentence of Section 6-105(F) and all of Section 6-105(C),
Monroe County Land Development Regulations, will not have been
met.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regulation meeting of said Board
held on the 15th day of September, A.D., 1987.
