RESOLUTION NO. 094-1988
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA,
AUTHORIZING THE CHAIRMAN OF THE BOARD TO
EXECUTE AN AGREEMENT FOR FROZEN FOOD STORAGE
BETWEEN THE MONROE COUNTY SCHOOL BOARD AND
MONROE COUNTY.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that said Board hereby authorizes the
Chairman of the Board to execute an Agreement for Frozen Food
Storage, a copy of same being attached hereto and made a part
hereof, between the Monroe County School Board and Monroe County.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of February, A.D. 1988.

AGREEMENT FOR FROZEN FOOD STORAGE
THIS AGREEMENT made this day of
1987, between Monroe County School Board, an agency of the State
of Florida, having its main office at 242 White Street, Key West,
Florida, hereinafter "Board" and MONROE COUNTY, a political
subdivision of the State of Florida, hereinafter "County."
In consideration of the mutual covenants contained herein,
the Board and the County agree as follows:
Section 1
The Board hereby agrees to lease to the County, and the
County hereby rents and hires from the Board, sufficient frozen
food storage space at the frozen food locker located at
812 Southard Street, Key West, Florida, to accommodate foodstuffs
at a monthly rate of $150.00 ($1,800.00 annually) payable in
equal insta1ments in advance on the 5th day of each month. This
agreement shall commence on October 1, 1987 and terminate
September 30, 1988, contingent upon the approval described in
Section 4.
Section 2
The Board shall be liable to the County for any loss result-
ing from mechanical break-downs, theft, fire, and strikes but not
or losses caused by interruption of electrical service or acts of
God.
Section 3
The Board shall provide access to the premises described in
Section 1 to the County during the hours of 8 a.m. - 4 p.m., five
(5) days per week.
Section 4
Pursuant to Section I of a general revenue/federal funds
contract between the County and the State of Florida, Department
of Health and Rehabilitative Services (HRS) dated October 1,
1986, Federal ID No. 59-6000749, this agreement shall not be
effective until approval is obtained from HRS.

Section 5
Either party to this agreement may cancel the same at any
point during its term provided that the cancelling party supplies
the other at least fifteen (15) days' notice. In the event the
County should cancel the agreement it shall pay a pro rata share
of the monthly payment due up to the date of termination. In the
event the Board should cancel the agreement, it shall refund that
part of the payment proportionate to the remaining portion of
that month.
IN WITNESS WHEREOF the parties hereto have set their hands
and seals on the date first above written.
