RESOLUTION NO. 185 -1988
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZ-
ING THE MAYOR AND CHAIRMAN OF SAID BOARD TO
EXECUTE A LEASE BY AND BETWEEN VICTOR DeMARIS
AND MONROE COUNTY FOR THE PURPOSE OF PROVID-
ING TEMPORARY STORAGE FOR ABANDONED VEHICLES.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as follows:
1. That the Mayor and Chairman of said Board is hereby
authorized to execute a Lease by and between Victor DeMaris and
Monroe County, Florida, a copy of same being attached hereto, for
the purpose of providing the Municipal Service District temporary
storage for abandoned vehicles.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 19th day of April, A.D. 1988.

LEASE

THIS LEASE, made this day of , A.D.,
1988, by and between VICTOR DeMARIS of the County of Monroe,
State of Florida, hereinafter referred to as Lessor and MONROE
COUNTY, a political subdivision of the State of Florida, herein-
after referred to as Lessee.
WIT N E SSE T H:
That in consideration of the covenants herein contained, on
the part of said Lessee to be kept and performed, said Lessor
does hereby Lease to said Lessee the following described proper-
ty:
A parcel of land within Industrial Subdivision
as shown by a plat recorded in P.B. 3, at page
132 of Monroe County Florida Public Records, and
as outline in Exhibit "A" attached.
TO HAVE AND TO HOLD the same for the term of two (2) years
from the
day of
, A.D., 1988, provided,
however, either party of this Lease may cancel said Lease upon
sixty (60) days notice in writing. The Lessee shall pay to the
Lessor the sum of Three Thousand Seven Hundred Fifty-five
($3,755.00) Dollars per month. The first payment shall be made
thirty (30) days after execution of this Agreement, subsequent
payments shall be made on or before the first day of each month
thereafter.
This Lease is made upon the following conditions:
1. The property is to be used by the Lessee for a tempo-
rary storage of abandoned vehicles.
2. The Lessee shall not assign this Lease or sublet any
part of the premises without written consent of the Lessor.
3" The Lessee shall maintain the leasehold premises in a
sanitary and orderly manner and comply with the laws of the State
of Florida.
4. The Lessee shall hold the Lessor harmless from any and
all causes of action, suits or claims that may arise by virtue of
third parties using the leasehold premises and Lessee covenants

and agrees that it will protect the Lessor against any and all
causes or manners of actions that may arise from third parties by
virtue of any injuries or damage caused to said third parties
while in, around, or upon the leasehold premises.
5. Upon the termination of this Lease, the Lessee shall
return the property being leased to its original condition
including but not limited to the removal of stored vehicles and
other material placed upon the property during the term of this
Lease.
6. The Lessee agrees to reimburse the Lessor for any costs
incurred in the enforcement of this Lease, including but not
limited to reasonable attorneys fees.
7. The Lessee agrees to bear the cost of all utility
service during the time of tenancy.
