Resolution 207-1988 County Commission RESOLUTION NO. 207 -1988 A RESOLUTION REQUESTING THE STATE OF FLORIDA THROUGH THE DEPARTMENT OF NATURAL RESOURCES TO MAKE CERTAIN PROVISIONS FOR THE CONTINUED USE OF THE FIRE STATION AND ITS PROPERTY LOCATED ON KEY LARGO; TO AFFORD THE COUNTY AT LEAST TWO AND ONE HALF ACRES FOR THE FUTURE LOCATION OF THE TRANSLATOR TOWER, THE SAME TO BE AFFORDED OR MADE AVAILABLE IN FEE SIMPLE WITHIN SIX MONTHS FROM THE DATE OF THIS RESOLUTION AND PROVIDE THAT ALL ACCESS TO THESE LANDS, WILL BE AVAILABLE TO THE COUNTY. WHEREAS, the State of Florida is now concluding the purchase of Port Bougainvi11e and Garden Cove; and WHEREAS, for many years, under lease, the County has had a fire station in the Garden Cove area, located between Highway 905 and U. S. 1,; and WHEREAS, it is utterly necessary to retain a fire station in this area for the protection of the properties both of the County, it citizens, and in actuality to afford protection for State facilities that will probably be located in any park that is placed in the area; now, therefore, BE IT RESOLVED BY THE COUNTY COMMISSION OF MONROE COUNTY, FLORIDA, as follows: Section 1. That the State of Florida afford to the County assurances, in writing, that the two and one half acres upon which the present fire station is now located be deeded to the County in perpetuity in fee simple. That in addition to the fire station the same shall be the prospective location of the translator tower when moved. Section 2. That as a secondary means of affording the County the properties needed and necessary for the purpose of both the translator and the fire station and should it be impos- sible to transfer the two and one half acres upon which the present fire station is located the State of Florida will make available to the County not less than one half acre at the fire station for training purposes; that in that event an additional two and one half acres shall be located elsewhere in State-owned lands for the purpose of moving the translator at some future time. It is to be noted that the translator tower is not only for the purpose of transmitting television signals, but is also used as a public service for the transmission of the EMS, Civil Defense, Sheriff, and other emergency transmissions required in the interest of the public of Monroe County. Section 3. That if the two and one half acres to be afforded to the County is other than on the present fire station locality it shall be made available to the County in fee simple in not more than six months from the date hereof. That the use of these lands for the purposes herein designated shall be certified and permitted by the State at the time of transfer. Section 4. That access be made available at all times to any and all lands afforded to Monroe County by the State.
