Lyt~on, Sr. Mayor Pro Tem RESOLUTION NO. 003-1989 A RESOLUTION AMENDING RESOLUTION NO. 174-1988 IN ORDER TO PROVIDE THAT A COPY THEREOF BE SENT TO THE HONORABLE CONNIE MACK, U.S. SENATOR, AND THAT A LETTER, DATED OCTOBER 12, 1988, FROM PAULA L. ALLEN, LEGISLATIVE ANALYST OF THE HOUSE NATURAL RESOURCES COMMITTEE, BE INCORPORATED BY REFERENCE. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE ~OUNTY, FLORIDA, as follows: Section 1. That Section 2 of Resolution No. 174-1988 be amended to read as follows: "2. That the Board of County Commissioners does hereby seek and implore the Honorable Governor, State of Florida, its Legislative Delegation, the Honorable Larry Plummer and the Honorable Ron Saunders, its Congressional Delegation, the Honorable Lawton Chiles, United States Senator, the Honorable Robert Graham, United States Senator, and the Honorable Connie Mack, United States Senator, and the Honorable Dante Fascel1, Member of Congress, to actively and publicly oppose the proposal of the U. S. Department of the Interior to designate portions of the Florida Keys as barrier islands." Section 2. That Resolution No. 174-1988 is hereby amended by the addition of Section 4 to read as follows: "4. A copy of a letter dated 10-12-88 from Paula L. Allen, Legislative Analyst of the Florida House Natural Resources Committee, is hereby attached and incorporated by reference." I Section ~ of CS/CS/HB 118 is not applicable to Monroe County because it addresses barrier islands in counties where coastal construction control lines have been established. There is a 50 foot se~back line established by the state for all coastal property in Florida but the Department of Natural Resources (DNR) has never established coastal construction control lines in Monroe county. DNR does not consider Monroe County to be within its coastal construction control line jurisdiction because it has no naturally occurring sand beaches. Section 2 of the bill is applicable to Monroe County only if beach driving is currently authorized by the county ~r any local government within the county. This section provides that authorized beach driving can be continued only if the local government determines that less than 50 percent of the parking spaces needed during peak user demand times is available. This determination is to be made by the local government in accordance with rules established by DNR. To my knowledge, none of the local governments in Monroe County have authorized beach driving, so section 2 is also inapplicable.
