BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA THAT: The administrative decision of the Planning Director in Land Use District Map Boundary Interpretation Number 23 dated December 21, 1988, attached and incorporated by reference, is hereby acknowledged, found to be in conformance with the standards set forth in Sec. 9.5-3(m}, Monroe County Code, and approved. Summary of Request/ReportThe boundary between NA and IS is imprec i se on the maps signed by Charles Pattison and effective September IS, 1986. The owner of Lot 6 applied for a boundary determination to devel- op a single family home on this previously cleared and filled lot. As a resul t of a site visit by a County Biologist, the upland wetland line was found to be between Lots 5 and 6 and not between Lots 7 and 8 as shown on the land use district maps signed by Donald Craig on January 19, 1988. Attached documentation:~Yes___No MEMORANDUM DATE: December 21, 1988 TO: Monroe County Board of County Commissioners FROM: Donald Craig RE: Boundary Determination for Summerland Estates Block 4, Lots 6 and 7 ----------------------------------------------------------------- Background: The owner of lot 6 has applied for a boundary determination in order to develop a single family residence on a lot previously cleared and filled. Lot 6 and 7 are shown as being in the Native Area land use district on the current land use district map. Recommendation: Move the NAilS boundary from between Lots 7 and 8 to between Lots 5 and 6, thus including both Lot 6 and Lot 7 in the Improved Subdivision land use district. Alternatives: Allow these lots to remain in the Native Area which would be inconsistent with the intent of the NA to protect wetlands. Findings of Fact: 1. The designation of the above property as Improved Subdivision (IS) rather than Native Area (NA) will be consistent with Section 9.5-213, Purpose of the Improved Subdivision District and uses allowed within the district, Section 9.5-242. 2. The determination was made based on the following: The zoning maps in use before the Land Use Plan show Lots 6 and 7 as RU-1. The Land Use District Maps and dated February 28, 1986, boundary. signed by Charles Pattison imprecisely show the NAilS The Land Use District Maps signed by Donald Craig and dated January 19, 1988, show Lots 6 and 7 as NA. Lots 6 and 7 are both vacant, scarified, upland lots, previously filled. -- -~-~-------------~-----~---_.--- - -. -~._- Lot 5 was not previously filled and is a wetland lot. 3. Analysis of the existing uses of the property and surrounding properties indicate that the essential neighborhood characteristics support the determination to designate the above lots as IS.
