INTERPRETATION NUMBER 24, SADDLEBUNCH
SHORES, LOT 2
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA THAT:
The administrative decision of the Planning Director in
Land Use District Map Boundary Interpretation Number 24
dated
December 21, 1988, attached and incorporated by reference, is
hereby aCknowledged, found to be in
conformance with the
standards set forth in Sec. 9.5-3(m),
Monroe County Code, and
approved.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 3rd day of January, A.D., 198'

Summary of RequestjReport:
Background:
Barbara Behler has applied for a boundary determination for Lot 2 in the
Saddlebunch Shores subdi vi sion on Saddlebunch Key. The lot is located
in a platted subdivision, but is currently utilized for the operation of
an antiques store.
The zoning maps in use before the new land use district maps were adopt-
ed show the lot zoned BU 1. The owner of the property would like commer-
cial zoning on her property so that the antique store will not be consid-
ered a nonconforming use.
Recommendation:
Leave the boundaries around the subject lot as they are currently shown
on the land use district map.
Findings of Fact:
1. The designation of the above-mentioned property as Suburban Commer-
cial, rather than Improved Subdivision, would be inconsistent with Sec-
tions 9.5-213 and 9.5-206, the stated purposes of the Improved Subdivi-
sion and Suburban Commercial Districts.
2. The determination was made based on the following:
a. The lot is located in a platted subdivision.
b. The use of the lot (an antiques store) does, and would not,
serve the needs of the planning area in which it is located.
c. There is no boundary involved. The lot is surrounded by proper-
ties designated Improved Subdivision. To grant this "boundary
change" would constitute spot zoning.
d. The surrounding lots are either developed or developable for
single family residences, provided all other provisions of the
land development regulations are met. The subject lot is the
only lot in the vicinity of the subject site which is commercial-
ly developed.
e. The zoning maps in use prior to February 28, 1986 show the
subject lot zoned BU 1.
f. The Pattison maps, adopted February 28, 1986, and the maps
signed by Donald Craig, dated January 19, 1988, clearly show
the subject lot designated Improved Subdivision.
3. Analysis of the existing use of the property and the surrounding
properties indicates that the essential neighborhood characteristics
support the denial of this application.

Subdivision district Suburban Commercial, including

Note: Alternative #2 would curtail the lawfully vested rights of the
owners of lots 1, 50 and 51, since residential use, for the most
part, is not permitted in the Suburban Commercial district.
