The administrative decision of the Planning Director in
Land Use District Map Boundary Interpretation Number 25
dated
December 21, 1988, attached and incorporated by reference, is
hereby acknowledged, found to be in
conformance with the
standards set forth in Sec. 9.5-3(m),
Monroe County Code, and
approved.

Recommended Action: Approve the boundary change so as to include the
subject properties in the Improved Subdivision district.
Summary of RequestjReport:
Background: ?~
Marshall and Marilyn Jones have applied for a boundary determination for
their property located on Caribe ~; 'lQ on Sugarloaf Key. The property
is divided into two sections, although it is not located in a platted
subdivision. The westerly section is approximately bisected by the
Improved Subdivision/Native boundary. The boundary then runs through
the southerwestly tip of the eastern section (See attached map).
The zoning maps in use before the new land use district maps were adopt-
ed show the lot zoned RU-1. The owner would like the entire property to
be included under one land use designation. They are contending that
Improved Subdivision is the appropriate designation to assign to the
property.
Recommendation:
Include the subject properties in the Improved Subdivision district.
Findings of Fact:
1. The designation of the entire above-mentioned property as Improved
Subdivision rather than Improved SubdivisionjNative would be more consis-
tent with Section 9.5-213, Purpose of the Improved Subdivision district,
and uses allowed within the district, Section 9.5-242, than with Section
9.5-210, Purpose of the Native district, and uses allowed within the
district, Section 9.5-239.
2. The determination was made based on the following:
a. The zoning maps in use before before the Land Use Plan show the
property zoned RU 1.
b. The Land Use District Maps signed by Charles Pattison and dated
February 28, 1988, imprecisely show the Improved
SubdivisionjNative boundary.
c. The Land Use District Maps signed by Donald Craig and dated
January 19, 1988, show the subject property designated Improved
Subdivision, in part, and Native, in part.
d. The County Biologist has inspected the subject site and
determined that the habitat on the property does not warrant the
Native designation.
e. Designating the subject parcel anything but Improved
Subdivision or Native would constitute spot zoning because of
the size of the parcel.
f. Although the subject parcel, and the adjoining land immediately
to the east, is vacant, the land immediately to the west is
developed with single family houses.
g. The subject property lies between Indian Mounds Estates and
Perez subdivisions.
h. The lots would be unbuildable if designated entirely Native.
3. Analysis of the existing uses of the property and surrounding proper-
ties indicate that the essential neighborhood characteristics support
the determination to designate the above-mentioned property Improved
Subdivision.
