Resolution 271-1994 RESOLUTION NO. 271 1994 A RESOLUTION AMENDING RESOLUTION NO. 103- 1990 AUTHORIZING THE TAX COLLECTOR OF MONROE COUNTY TO MAKE A REFUND OF A $10.00 ASSESSMENT FEE FOR THE CROSS KEY WATERWAY LIGHTING DISTRICT TO BE PAID FROM CROSS KEY WATERWAY FUND #713 WHEREAS, on August 18, 1987, the Board of County Commissioners created, by Ordinance No. 031-1987, a municipal service taxing unit known as the Cross Key Waterway Special Lighting District; and WHEREAS, a referendum was held to dissolve the CROSS KEY WATERWAY Special Lighting District on August 8, 1989, according to FS 165.051; and WHEREAS, the Municipal Service Taxing Unit was funded as an ad valorem levy (fiscal year 1987-88) of the old CROSS KEY WATERWAY Estates Special Local and Bridge District; and WHEREAS, $10.00 per lot was assessed; and WHEREAS, none of the $10.00 per lot special assessment was spent; and WHEREAS, the Board of County Commissioners as the District governing body, desires to refund the tax revenue collected and to make certain minor changes to Resolution No 103-1990; now, therefore j ) l ~HlU ,~iOtJNGI~ :'j -lJ BE IT RESOLVED BY THE BOARD O~i\'COUNTY COMMISSIONERS OF MONROE COUNTY, ~~q~ID~, l~~ f~~ows: :>Hn J! ~l:! CLn:..-j Section 1. Resolution No. 103-1990 is hereby amended by revising Section 1 therein to read as follows: An application by the taxpayer on Form DR-462 must be made to the Tax Collector, who will attach whatever proof is necessary and forward the application to the Department of Revenue, which will approve or reject it. If approved, the Department notifies the Tax Collector who then informs the Board of County Commissioners of the decision to request funds from the Commission to pay the applicant/taxpayer. Accordingly, the Monroe County Tax Collector is hereby requested and authorized to refund, to the owners of record, the $10.00 per lot assessment fee, less the service charge of the Tax Collector, if any, upon proper and timely application to the Tax Collector by said owners of record. Section 2. In all other respects, Resolution No. 103-1990 remains in full force and effect. PASSED and ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a regular meeting of the Board held on the 21st day of September, 1994.
