Resolution 227-1988 RESOLUTION NO. 227 - 1988 A RESOLUTION AMENDING RESOLUTION NO. 371-1987, PROVIDING THAT CERTAIN NAMED CODE ENFORCEMENT OFFICIALS ACTING UNDER THE SUPERVISION AND DIRECTION OF THE CODE ENFORCEMENT ADMINISTRATOR ARE VESTED WITH THE POWER TO ISSUE CITATIONS AND NOTICES TO APPEAR IN COUNTY COURT FOR VIOLATIONS OF THE MONROE COUNTY CODE, AND AUTHORIZING AND DIRECTING THE COUNTY ADMINISTRATOR OR HIS DESIGNEE TO REQUEST THE CHIEF JUDGE OF MONROE COUNTY, FLORIDA TO AMEND THE UNIFORM BOND AND GUILTY PLEA SCHEDULE TO PROVIDE FOR A BOND AND FINE FOR VIOLATIONS OF THE MONROE COUNTY CODE IN THE AMOUNT OF $150.00, TOGETHER WITH APPROPRIATE SURCHARGES THEREON FOR A TOTAL OF $232.50. WHEREAS, House Bill No. 3557, Chapter 76-435, Laws of Florida, authorizes County Building and Zoning Enforcement Officials to issue citations for violations of County ordinances; and WHEREAS, MONROE COUNTY has determined to ~mplement the aforesaid Special Act and has adopted the appropriate Ordinance to do so; and WHEREAS, it is desired that County Building and Zoning Enforcement Officials acting under the supervision and direction of the Code Enforcement Administrator be empowered to issue Citations and Notices to Appear in County Court for violations under the County Code; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Monroe County, Florida, that: Sect~on 1. L. Gene Favors, Woodrow Niles, Sally Linck, Charles Eaves, Harry Jackson, Marty Arnold, Ronald Joseph Stack and all others certified subsequently, acting under the direction and supervision of the Code Enforcement Administrator, are hereby authorized as Building and Zoning Enforcement Officials to issue citations for violations of any Monroe County ordinance; providing, however, that such enforcement officials shall not have the power of arrest nor be subject to the provisions of Section 23.061 through Section 23.078, F. S., relating to the Police Standards Board. Section 2. Every designated Monroe County ordinance enforcement official, upon issuing an ordinance violation citation to an alleged violator, shall deposit the original and one copy of such ordinance citation with the County Court having jurisdiction 1 over the alleged ordinance violation offense. Section 3. Every designated Monroe County ordinance enforcement official shall follow the procedures providing for the dlsposition of citations and the prosecution thereof enumerated in Chapter 76-435, Laws of Florida, and Ordinance No. O~D- lC}x<?( of Monroe County, Florida. Section 4. The County Administrator or his designee is hereby authorized and directed to request the Chief Judge of Monroe County, Florida to amend the Uniform Bond and Guilty Plea Schedule to provide for a bond and fine for violations of the Monroe County Code in the amount of $150.00, together with appropriate surcharges thereon for a total of $232.50. Any and all actions to accomplish this directive already undertaken by the County Administrator or his designee are hereby ratified and confirmed.
