BOUNDARY INTERPRETATION OF THE PLANNING
DIRECTOR IN LAND USE DISTRICT MAP BOUNDARY
INTERPRETATION NUMBER 7, CUDJOE GARDENS THIRD
ADDITION
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS \ OF
MONROE COUNTY, FLORIDA that:

The administrative decision of the Planning Director in Land
Use District Map Boundary Interpretation Number 7, dated July 26,
1988, attached and incorporated by reference, is hereby
acknowledged, found to be in conformance with the standards set
forth in Sec. 9.5-3(m), Monroe County Code, and approved.
PASSED AND ADOPTED by the Board of County commiSSi~ers of
Monroe County, Florida, at a regular meeting of said Board held
on the 16th day of August, A.D., 1988.

Boundary Determination for Cudjoe Gardens-3rd Ed.
Block 14; lots 5, 6, and 11

Background:
On March 22, 1988, the owner of the subject property wrote a
letter, attached, requesting a boundary determination to correct
what he felt was an error in the Land Use Di strict Maps dated
1/19/88.
Recommendation:
Extend the SC boundary to include Cudjoe Gardens, Block 14,
Lots 5, 6, and 11.
Findings of Fact:
1. The designation of the above property as Sub Urban
Commercial (SC) rather than Improved Subdivision (IS) will be
consistent with Section 9.5-206, Purpose of the Sub Urban
Commercial District, and the uses allowed wi thin the district,
Section 9.5-235.
2. The determination was made by the Planning Director and
based upon the following relevant data:
On the zoning maps in use before the Land Use Plan
these lots were RU-3, which was not a single family
home zoning.
On the Land Use Maps signed by Charles Pattison and
dated February, 28, 1986, the boundary is not
precise but appears to include these lots in SC.
The property is under common ownership with
adjacent lots 7-10 which are SC and have a
restaurant and marina.
The current land use of lots 5, 6, and 11, is
vacant.

zoning, pre 1986, was not single-family but RU-3.

change had occured, by Planning Dept. Staff.
I hereby request that the new Land Use Map dated 1/19-88
be corrected to show SC boundery to include Lots 5,6,and 11.
