A RESOLUTION OF THE BOARD OF COUNTY Cm.n'HS-
SIONERS OF MONROE COUNTY, FLORIDA, AUTHORIZ-
ING THE MAYOR/CHAIRMAN OF THE BOARD TO
EXECUTE ADDENDUM NO. 7 TO AGREEMENT FOR
SERVICES BY AND BETWEEN MONROE COUNTY BOARD
OF COUNTY COMMISSIONERS AND GALLAGHER BASSETT
SERVICES, INC. FOR THE PURPOSE OF AMENDING
THAT CERTAIN AGREEMENT ENTERED INTO BY THE
PARTIES THERETO DATED OCTOBER 1, 1986,
REGARDING THE WORKERS' COMPENSATION CLAIM
SERVICE.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Mayor/Chairman of the Board is
hereby authorized to execute Addendum No. 7 to Agreement for
Services by and between the Monroe County Board of County Commis-
sioners and Gallagher Bassett Services, Inc., a copy of same
being attached hereto, pertaining to the Workers' Compensation
claim service.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board held
on the 20th day of September, A.D. 1988.

TO
AGREEMENT FOR SERVICES
BETWEEN
MONROE COUNTY BOARD OF COUNTY COMMISSIONERS
AND
GALLAGHER BASSETT SERVICES, INC.
PERIOD OF AGREEMENT: October I, 1986- continuous
EFFECTIVE DATE OF CHANGE: October I, 1988
It is hereby noted and agreed that Item III (Compensation) of
this Agreement is amended to read:
"EMPLOYER shall pay SERVICE AGENT for services rendered
herein the annual sum of TWENTY-SIX THOUSAND ONE HUNDRED FORTY-
FIVE DOLLARS ($26,145.00), payable annually. Fee is Minimum and
Deposit for 175 Workers Compensation claims. All additional
claims are to be billed at $125.00 each. At the end of each year
of this Agreement, the annual compensation shall be subject to
the increased cost of living factor based upon the United States
Consumer Price Index and shall be subject to adjustment as
mutually determined by EMPLOYER and SERVICE AGENT. SERVICE AGENT
agrees to notify EMPLOYER in writing of any increase in service
fee ninety (90) days prior to each anniversary."
All other terms and conditions remain unchanged.

IV. ODLIGl\TIONS
SERVICE l\GENT will supervise i1nc1 ildminister its obliqations under the Risk
~~<ln.J.gCP.lent Plan of the E1':E"'LOYSr" i:1 full comrliance \.:i th all 2.pplicable laws, rules
und regula~ions governing the! administriltion of the self insurance portion of
the program; and SERVICE AGJ~NT will act as the representative of the E1-1PLOYER in
all matters related to such administration and will perform' fully all the below
listed functions:
A, CLAn,s:
1. COJllplete handling of all loss adjustments, in-yestigations and
settlements falling within the EMPLOYER'S self insured retention.

2, Maintain a claim file for each reported claim, submit monthly
experience reports, provide complete accounting for the program
\"hich at all times is subject to review by the E1'>IPLOYER.
3. Recommend claim reserves and provide a continuous review and
updating of these to reflect changes.
4, All sizable and unusual claims will be reviewed by SERVICE
AGENT'S internal legal staff at no additional charge to the
E~1PLOYER,
5,

Coordinate investigations on litigated claims with attorneys
approved by the EMPLOYER and with adjusters and attorneys of the
excess insurance carrier as required,
6,
To obtain approval from the EMPLOYER'S Director of Risk
Management before paying any claim in excess of Ten Thousand
Dollars ($10,000,00) and to furnish precautiona:r:.Y..L~.Et~on all
serious claims.

7, Be available to consult '",i th the Er'lPLOYER' S Director of Risk
t-lanagement on any related claim matters and to make available
SERVICE l\GENT'S staff of professionals to assist in achieving
a successful risk management progrJm,
8, In the event of cancellation of this Agreement to perform these

B. LOSS PREVENTION:'
SERVICE AGENT'S Loss Prevention services will be provided in the
following areas:
1, Assist Director of Risk t-1anagement in development of the Safety
and Loss Prevention Program,

2, Assist in conducting fucilities inspections/presentations,
Following such inspections/presentations, reports and recommendations
will be submitted to the Director of Risk Management with respect
to the identification, measurement and control of loss producing
causes in the areas of:
a, Physical facilities other than boiler and machinery

c, Workers Compensation
3, Provide analysis of computerized loss date to identify and control
loss proble~ areas.

V. CONSIDE&\TION
The promises made and the obligations assumed by each party to this Agreement
are made and assumed in consideration of the promises made and the obligations
assumed by the other Party to this ~greement.
The EMPLOYER is making this Agreement specifically with the SERVICE AGENT and
that same is intended to be a personal service Agreement,
SERVICE AGENT shall not assign this Agreement or any responsibilities pursuant
to said l'.greement without the c>:p!"css consent of the E1'IPLOYER,
Tile parties hereto, may, by mutui11 written agreement, change the scope of services
or the amount of compensation set forth hereinabove in th>is Agreement.
