RESOLUTION NO. 525-1988
A RESOLUTION OF THE BOARD OF COUNTY COMMIS-
SIONERS OF MONROE COUNTY, FLORIDA, SITTING AS
THE BOARD OF APPEALS DENYING THE APPEAL OF
FOUR STAR BUILDERS, INC. REGARDING THE
IMPOSITION OF IMPACT FEES AND DIRECTING THE
PLANNING DEPARTMENT TO TAKE ALL APPROPRIATE
STEPS TO PLACE THIS ROAD ON THE COUNTY'S
CAPITAL FACILITIES PLAN.
WHEREAS, Four Star Builders, Inc. has appealed to the Monroe
County Commission with the respect to the imposition of impact
fees on its project located in Big Pine Key, Florida, and
WHEREAS, the owners of said facility, Mike Gilbert and Bill
Lemon have indicated that they would not object to the imposition
of impact fees if the said fees were used for the construction
and maintenance and improvement of a road which would provide
access to their property, and
WHEREAS, the Monroe County Commission has fully examined the
issues, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA sitting as the BOARD OF APPEALS, that:
1. The appeal of the imposition of impact fees by Four
Star Builders, Inc. is hereby denied.
2. The Monroe County Planning Department is directed to
take all necessary steps to place the roadway which provides
access to the facility of Four Star Builders, Inc. on the Coun-
ty's Capital Facilities Plan and to ultimately bring the roadway
into the Monroe County road system and to utilize the impact fees
paid by Four Star Builders, Inc. in the construction and improve-
ment of the said roadway.
