ITEM BACKGROUND: Monroe County requested a time extension of one year (April 25, 2003 to April 25,2004) on the above Agreement to allow the additional time necessary to resolve the issue with the non _ compliant windows in the Gato Building. FEMA granted an extension through May 25, 2004, which was thirty more days than the County requested. FEMA has now issued the Modifications referenced above, which Modification provides for an additional 83-day extension of time through August 16, 2004. Additional time may be needed in order to bring the windows into compliance, so, as noted below, staff recommends the acceptance of the additional 83 days being offered by FEMA PREVIOUS RELEVANT BOCC ACTION: At the February 21, 2001, Board of County Commissioners meeting the Board granted approval and authorized execution of an Agreement, Contract No. 01HM-4R- 11-54-15-009, between Monroe County and the State of Florida, Department of Community Affairs in acceptance of Hazard Mitigation Grant Program funds for the FEMA Project 1259-0019, Gato Building Retrofitting Project. WHEREAS, the Agreement expired April 25, 2004; WHEREAS, the parties desire to reinstate and extend the Agreement to August 16, 2004 in order for the Recipient to complete the Scope of Work, as set forth in Attachment A; and NOW, THEREFORE, the parties agree to reinstate, extend and modify the above referenced Agreement as follows: 1. Paragraph (3) of the Agreement is hereby deleted in its entirety, and the following paragraph substituted in its place and stead for all intents and purposes: This Agreement shall begin April 25, 2001 and shall end August 16, 2004, unless terminated earlier in accordance with the provisions ofparagraph (9) of this Agreement. 2. Except as modified herein, all other provisions of the Agreement shall stay in full force and effect.
